MarvBear, I was approved for the 61k loan! When I signed the paper work, they disclosed my score at 679. The bank that approved my loan was Audi Financial Services. I submitted two pay-stubs and that was it. Very painless. All I put down was a 1000 dollars. It was zero down, but I wanted to cover some initial cost. My interest rate was awesome (2.7%), that was the promotion that my Audi dealership had. I will refinance to the 1.9 with my CU later on, but the .7 difference will not break the bank. Lastly, I decided not to trade my vehicle, the amount they wanted to give me was really low and in the end, after they made some calls and doubled their offer. I did not take their offer but they were pretty aggressive to get my trade in. I was baffled on why they doubled their offer and kept explaining the benefits of trading, i.e. tax savings etc. Why the push, if you don't mind me asking? Thanks for looking at my initial post and giving me the confidence to continue the process at the dealership!

First, thanks to the Forum, I have removed 17 baddies from each of my three credit reports. REPO's, Credit Cards, Installment loans, and CA's from electric companies to Medical obligations, have come off because I have followed the advice from you all. I began my Journey on January 9, 2012 with a EQ score of 489, TU, 511, and EX 506 (first credit pull was from EC, TU, and USAA) and as of today, I am now sitting in the mid 600's. I have gone from 1500 dollars of revolving secured credit cards to 40k in unsecured credit. No fancy tricks and I didn't pay anyone-except the post office, NFCU Visa Signature $25,000 USAA Mastercard $9500 Barclay's Apple Visa $2600 (approved for $1300 and recon'd for $2600 zero interest 12 months!) Discover More $1000 (I am happy because I just signed up for the 5% off on gas/entertainment for the rest of the month. I didn't know credit cards did this!!!!) Firestone $1200 Capital One $1000 (Secured) NFCU Rewards $500 (Secured) Having said that, I am almost done and I need your help on the following below. I will list the accounts and then at the bottom I will notate what I have done. Please advice at your convenience. Again, I can not thank you enough. Enhanced Recovery: They just popped up on my reports at the end of Feb. I have Texas DV these clowns. Their 30 days are up on 4/2/2012 and are under the 60 day notice to cure if they don't respond. Conn's: I sent each CRA the itemized concerns and they came back verified. To be honest, it looks right. I sent a request to Conns for a PFD total balance (it was a nice letter) and I was shot down, twice. Navy Army: I followed the exact same step as I did Conns but I only sent one request for PFD with Collections Director-he said no to the full amount. Both Mentioned integrity of the credit system. BLAH... HSBC: I sent the CRA a list of concerns and they updated the info as they have sent this account to Midland. Midland: I have DV these guys three times and they have many, many, Texas violations and they are currently being reported to the BBB (response pending) and on the 60 right to cure. Web: I sent the CRA a list of concerns and they updated with what you see above. I want these guys gone too. Your help is appreciated.

What if 1 party declines consent to record the call?

I am not a lawyer so IMO, I believe you are correct. As long as one party member knows that the call is being recorded then you are fine (you don't have to advice the calls being recorded-applies to TEXAS). It is my understanding that a call being recorded by a third party will not hold up in a court of law. For example, your significant other is listening and recording the conversation without you or the other party's permission would be difficult to use in court. Hypothetically speaking, say the OC sues you because you are within SOL and they file in their jurisdiction, you will have to play by their state rules unless you sue first and file in Texas. I am too tired to look up case law, but take a look, its pretty interesting. The general statement that "this call is being recorded" is used as an umbrella disclaimer to satisfy different state requirements. Best of luck and I will look for case law tonight for you or cheat and call my buddy who's an attorney (that seems faster.) I'll PM you for tips on Enhanced Recovery and how you got rid of those tools. -
As far as I could see there was no copy of the OC account data, no proof of ANY kind that they have any of the required information and certainly no documentation of an existing business relationship between them and the OC. How old is this account?? These account are less than two years old, and I am prepared to pay them. Do you have ANY independant verification that any of these bills are valid?? Yes, I have EOMB's, but they do not match up to the amount that they are asking for (it's less than the total on my EOMB) For instance, copies of original bills from the OC?? I do not have any copies of the original bills from the OC, but I can call and get them. If I am able to make the connection between the CA and the OC, can I submit a settlement amount and still have the OC recall the debt from the CA? You may have had all this on your original post, if you had one, this is why we ask folks to keep ALL their follow ups in the same thread. WC, This is my first post about this topic. In the future if I have a follow up I will be sure to update in the same thread. I have responded in red to your questions, thanks for helping me.

Below, you will see the steps that I've taken during the WhyChat Process. My question is about the letter I received from the collection agency. Does this letter satisfy as a documented current relationship between the Health Care Provider and the Reporting CA? For you to review the document, I have redacted all personal information. I will tell you that the CA had listed the 5 accounts in question, total amount due, and the name of the Hospital that reported the debt to the CA. Final question question, since I have this info from the CA, can i complete the last step which is to send the Letter to the Health Care Provider. Steps that I've take: 1. Removed all previous addresses from each CRA. 2. Sent each CRA a Handwritten Pre HIPPA Medical Dispute Letter. 2a. Each CRA responded to my request. TU and EQ verified and Experian removed 2 of the 5 accounts. 3. Sent a DV letter to Collection Agency that is reporting the 5 accounts 3a. Received Response, see attached letter 4. Sent a CMRR Follow up letter to the CRA, no response as of yet. 5. PENDING FINAL STEP, LETTER TO HEALTH CARE PROVIDER Letter I had a hard time trying to add the jpg, here is the photobucket link in case it does not appear. Greeting... Having sent my validation request to the CA's, I am ready for part two of the punch-CRA Verification. I have searched high and low for a letter that will go to the CRA (not too tough and not too soft) to begin the dispute/verification process. However, I am coming up short of the right one. Thanks for your feedback, Jaybee! Currently, I have a 1000 cl with Capital One (15 month old secure/unsecure acc.) 500cl with NFCU secure visa card (on the way) an installment account with NFCU (just started yesterday) and lastly, the Zync Amex. I will get to B*. Again, thanks for the advice. That depends, I would suggest getting some starter cards and let them age for 6 months - that's a good time for B*. Now, I don't know your FICO scores, but if you sent out 9 DV's I'm going to assume your scores are probably pretty low, around the mid 500 range (key word is assume). If that is the case, I would probably get 2 secured cards to start with (Cap1, Orchard bank, etc). After the hard inqs from those cards show up, I would begin B*. Oh, I would also freeze EX before I apply for anything. -
Welcome my fellow NEWBIES! Just like you, I am brand new to posting to the forum. As you navigate through the site, you will quickly realize that there is so much information. After my first day of reading, I wanted to go bonkers. In a short time, I became addicted to reading and learning about my rights as a borrower and the obligations that a lender or CA must be held to. If you have yet to figure out, the process of correcting your credit past can be frustrating and rewarding (wait, you will see...) I never felt so empowered until the day I dropped off my initial letters to the CA. As a heads up, make sure you get plenty of post in the forum so that you may have access to the veterans profile! I've been reading for two weeks now and you will learn quickly that some of the Vets are very knowledgeable. The only problem is that certain concepts that the vets will cover may go over your head. Don't let that discourage you, continue to read along until you find what you are looking for. Good luck to you all and get ready for hours of staring at the computer-forgetting to blink. One last thing, if you guys come across some awesome self explanatory steps, please come back and post. For example, I read a 225 pg post on the concept of Bumping and in the end I still can not grasp it. I wish there was a conversation that simplified it like the hypothetical I've put in quotations. "if you want to work on Bumping (B*) Inquiries on your EQ report without the risk of being added to the Chopping (C*) list, sign up for Product A and run once a day. If you want to work on B* and reach the your goal of in less time (buying a car in 45 days, home loan, etc) sign up for product A, B, and C. Keep in mind that you risk getting C*. The three recommendations for running your credit report have been tested and they will work and not overlap each other etc etc etc- repeat steps for TU." As newbies, all of that information can be found, but it is never that easy, you must pull from all of your resources and eventually you will get it. DV is the easiest concept, start there. And don't forget me when you understand B* until then, I will request six soft credit reports from every site and their momma, haha. Now close the window you've just opened when you saw the term bumping and wanted to find out what it meant and get to reading. Wish you all the best! Laters. P.S. At what stage of the credit clean up process should you worry about Bumpage? Since I am just beginning, I feel like I should take it one at at a time. What are you thoughts? BTW, I spent a hundred dollars at the post office mailing my DV's to CA's (9 dv's and 6 to the CRA's)! I never imagined that I would need to spend that amount of money at the Post Office. I am sure it is worth every penny, right?
