  1. Why Chat - see below. While the judgment was vacated and I have paperwork showing it, the paperwork has not actually been entered into their system. There seems to be a big back log in this courthouse. Everytime I call, they say they cannot give a time when it will be entered. Unfortaunetly, I am in the process of getting a mortgage and need to get this removed and cannot wait any longer. Someone told me I should send a fax into Transunion and Experian--where this is reporting, and then send provide a copy of the signed order to vacate. They said when you fax, the CRA has about 5 days to resolve and correct the issue. I need the quickest way to get this deleted from my two reports. You will have to wait until the Court records show that the vacating order was entered and then send the normal dispute letter: http://www.whychat.5u.com/deletejudg.html DO NOT send any documentation, unless they do not delete.   2. Just a reminder that I have been through all of the DVs with the CA. Long story short they ended up getting a summary judgment since they were able to prove that I owed the money which I did. Part of me agreeing to pay the CA after the judgment was based on the fact that they would put in a consent order to vacate the judgment, which they did. They wouldnt agree to delete the collection account associated with judgement, but said they would mark as PAID instead--which they have not DONE yet. I was going to try to dispute it again with Equifax to see if I could get it completely removed, but by me disputing it the CA is likely to confirm it as PAID. I believe it has been a few years since the account was first reported was December 2008, which is why I was hesitant to dispute it again, since it might now come back as paid and lower the score. I was wondering if it might just be better to leave as is until I apply for the mortgage, but wasnt sure if it was worth a shot?
  3. Why Chat - I just checked my FICO score and it is at 730. Before I send my dispute to Equifax on the CA mentioned above, if the CA now marks the account as "PAID" as a result of my disputing it, will the PAID notation hurt my credit score vs leaving it alone for now? I am going to be applying for mortgage and dont want to chance having the score be lowered by having a PAID notation. RIght now it shows as an open collection account that is UNPAID, even though it is now PAID. Let me know. Thanks
  4. Thanks. I just wrote my two letters using http://www.whychat.5...deletejudg.html to Experian and Transunion and will be sending tomorrow. I write in on watermarked papers and in teal font and will be sending certified mail (not return receipt). Should I attached a copy of the page of my report that shows the judgment and circle it, or is the letter sufficient? Also, with regard the collection account associated with this judgment that is reporting on Equifax, I am going to dispute it again as you suggest. As i mentioned, in the negotiation I had with the CA attorney, they promised to consent to vacate the judgment and then mark the collection account on Equifax as paid. While they completed the paperwork for the court and submitted this to them in the past 3 weeks, they still havent marked the Equifax account yet paid. Do I give it a little time for them to mark it is paid and then dispute, or should I just go ahead now and dispute? I am not sure if these two things got crossed at the same time if it would present a problem to this strategy. Thanks
  5. Why Chat - I just received the papers from the court indicating that the judgment has been vacated. I am now going to proceed and send http://www.whychat.5...deletejudg.html to Transunion and Experian, where the judgment is reporting, The judgment is not reporting on Equifax (EQ). However, as I mentioned in previous post on this thread, the collection account associated with the judgment is still reporting on Equifax. It was never reporting on TU and Exp. Since the judgment associated with the CA is NOT reporting on EQ, you mentioned that I could go ahead and send the normal dispute letter http://www.whychat.5.../hipaadisp.html to EQ regarding the collection account that preceded the judgment. Please note though, that I I did dispute this with EQ in May 2012 and then again in July 2012 as part of the original process you and I discussed last year. In fact, after the second dispute, EQ put a fraud alert on my file in Aug 2012. I tell you all of this so that you have the full history before I go sending a new dispute to EQ, as I am not sure if it will alter the approach I take. As a last reminder, you may recall that the reason I got the judgment vacated in the first place was because I eventually made payment to the CA attorney who agreed to file papers to the court to vacate the judgment once payment was received. I also requested that they delete the CA account from my EQ report, but they just agreed to mark it as PAID on my report, which still hasn't happened. Please let me know your thoughts, as I would like to move into next steps quickly, After I get the judgment and CA removed, my work will be done as far as removing the baddies from my reports.   6. Why Chat - good news. I sent the certified check to the OC hospital with insert letter A last week. I just got the green card back. I checked each of my 3 credit reports tonight, since I got an alert on one of my credit report notifications that my score increased, and the collection account has been removed from each of the 3 CRAs. I was surprised that the OC removed this so quickly from the CAs. I was planning to send the follow up emails to the CRAs, but it looks like my work is complete here. Let me know if there is anything else I should be doing. I still have two separate issues to work out on different Accounts and which are on two other threads, but this is a big win. Let me know your thoughts. Thanks again for your help.
  7. Thanks. No lawsuit has happened yet, but i think one will be imminent. I just got the greencard back from the lawyer where they received my DV letter. Seems like I shold move quickly into action now with sending the OC the payment and HIPPA letter. Will report back.
  8. Thanks Why Chat. This may be tough to answer,but what is the likelihood of the OC sending back the check and telling me i need to deal directly with the CA? Are there any other potential risks to sending the letter and payment to the OC--especially since it looks lie the CA has handed this over to their lawyers?
  9. Hi Why Chat - I checked th backdoor on these for each of the 3 CRAs and it is still reporting. Also, I have some new information. I did receive a letter from the CA mentioning to me that the reason iI owe the money to the hospital is due to the fact that my insurance paid but then due to lapse in coverage requested payment back. This is actually correct information, which leads me to believe that they have a current business relationship with the hospital. They also informed me I the letter that if I want the specific medical records, I need to contact the hospital--and they provided the hospitals's contact info. In the letter they said they have also referred this to the law office, which is what I believe is the second letter I received from the lawyer. Anyhow, before I send the second letter (mentioned above) to the CRA, I was wondering if I should submit payment to the hospital. As I mentioned, I will be looking to get a mortgage and need the most expeditious way to get it removed. I am less concerned about paying the 800 dollars and more concerned about getting this completely removed from the report. I will still go ahead with the initial plan we discussed if you feel this would be best,but wanted you to have this new information. Thanks
  10. Yes. The current reporting CA is the one that I sent the medical DV to. Essentially, they sent me a letter a couple of months ago saying that I had 30 days to let them know if I dispute the validity of the debt. I did send them a certified mail within 30 days. They never sent me anything and then decided to put it on my 3 credit reports anyhow. Following this, I disputed this with each of the 3 CRAs, and they did not delete. At this point, I was going to send the CA this CMRR. http://whychat.5u.com/ltrcavalhipaa.html Once I got the return receipt, I was going to send each of the 3 CRAs this letter (but I haven’t done this yet, until I receive your instruction) http://whychat.5u.com/ltrcavalhipaa.html#DISPUTE Should I still do this? In meantime, what I was also referencing in my note to you was that after I received notification from the CRAs that the account was verified, I received a new letter from another CA for the same account that is already reporting. It looks like this letter is from a lawyer. It essentially said that I have 30 days to dispute the validity of the account. Three days ago I sent them this “new” CA a dispute letter CMRR. Thanks
