I have a class requiring me to survey people in regards to their opinion on the power of the prosecutor. I was wondering if I could get some of the fine members of CreditBoards to take a minute or two and complete the survey? It's anonymous and it's multiple choice. Thanks Doodle! That's some great advice! We are not using USDA, our income exceeds their minimum for our area, I had originally looked into USDA loans though. I'll have to look around for that disclosure sheet. I'm sure it isn't posted yet as the house is not priced. The potential leins is an issue that does concern me. That is somethign I will need to discuss with our agent.

Hey all Need help/advice on REO foreclosures. Recently we came across a Wells Fargo REO Foreclosure that is still waiting to have a price added. Our agent has been in contact with the agent that the bank is using to see when the property will actually be listed for sale. My agent emailed me today and told me that after speaking with the other agent there is interest from the neighbors in buying it. She is representing them, as well as the bank. I think this puts us at a very big disadvantage, since she will be getting the full commission rather than only half. So I have some concerns, one is that she will be providing them with key details like, date it will be posted and potentially what the bank is looking to sell it for before it is actually added to the market. My other concern is that she will be communicating our offer to the other potential buyers in order to make sure they win the property. I understand there really isn't anything we can do with the exception of offering our top dollar that we are comfortable paying, and potentially offer a quicker closing time. I am pre-approved with another lender, but wonder if I shouldn't also get a pre-approval through Wells Fargo? So any advice on how we should work this REO? I should add this is not an investment for us, it would be our home. Also I don't believe the other party interested is cash buyers. Online research states that both of those affect which offer is accepted. Thanks all in advance!

Hey all, I need some advice on what I can do, if anything. My family and I were in an accident a few years ago, my wife has just been released from all restrictions following a surgery that fixed her injuries from the accident. During this time the bills added up, the vehicle insurance companies paid their max, and my wife's insurance paid. So that left us with the patients responsibility. These where to be handled after my wife's recovery. Which most have been, some are still pending, but this is where I need the help, To make a long story short, my wife received collection letters over the accident from CBCS 21 on 10-20, I sent them Why Chats Validation/Dispute/Etc letter on 10-23 and it was received 10-25. Yesterday in the mail I have another letter from CBCS asking for payment for the same debt. It was dated 10-31, so 6 days after receiving they continue to try and collect on this debt. I contact our attorney who contacts the clinic. The clinic states they had erroneously sent it to CBCS and since they were paid and they would get it taken care of. This was after the 10-20 letter, and they claimed that it didn't get resolved until Nov 1. These are NOT on her credit reports. CBCS attempted to collect a debt 5 days after being sent the validation/cease/desist letter. They did NOT validate the debt before attempting to collect again. Is this a violation? If it is, is there a complaint that can be filed against them for this? If so can someone point me in the right direction? Thanks for any replies.. I have opted out and all that good stuff!

Thanks for the replies. uber: I have not payed, as from the topics I've read on here, it was my understanding not to pay until they have agreed in writing to the terms you requested or atleast to terms you both can agree on. I do have letters from them agreeing to delete after full payment, but it doesn't say they will delete in 15 days, 15 months, or 3 years. Maybe I should have clarified...I have asked for a specific amount of time for them to delete after payment is recieved. They only reply that they will delete after payment, and will not provide me with an amount of time before they will delete. I wil pay them, but not unitl I know how long it will before they delete after payment is made.

Hey all.. I have been dealing with a local CA over an account on my wife's report. She has two accounts posted from this CA, one has just passed the SOL for collections and the other has a few years. Anyway they agreed to handle one account at a time, they also agreed to my PFD request. However I have asked 3 times to get them to agree to delete with-in 15 days of receipt of full payment. The first two times they agreed to delete, but they would not specify how long before the delete. My last communication I asked them to specify in their response that they would delete with-in 15 days. All communications have been handled through the mail, and copies of everything have been made. I do want to pay for the account, I just cannot get them to specify a date. The account that just went out of SOL, was an error on the part of the OC and we refuse to pay for their screw up. Any ideas on how to handle the PFD since they didn't respond to my last request of specifying a number of days? Thanks

Thought I would post another update. I forwarded that email from the State dept of Labor to my employer. I never heard anything back. I checked my account today to see if my withdraws actually go out on a holiday. And guess what...my check was posted. I'm going to guess that the third party didn't want to go against state code. (They are not based in the state so they might not even know the code, since they have delayed pay dates in the past). Anyway, I'm glad I dug in and researched. I also posted in an earlier post that I didn't think my auto withdraws would go out on a holiday. They do, I have two auto's that go out on the 4th of every month, both went out today. So I was wrong, my bank does process auto's on holidays.

Update: So I had a reply to my inquiry to the State department of Labor. I sent a very detailed email to an executive officer in that department, explaining that it had only happened a couple of times, but it was very inconsistant, and that their exuses for the delay did not seem valid. All if shich are backed by email documentation. Anyway, I was given a complaint from to fill out, and when she replied she had highlighted some specific parts of Iowa code. Parts of her reply: Your employer should be paying you on consistent intervals. If you have a set payday of Friday then you should be receiving your pay on Friday. If your employer has not paid you, a claim form is available on the following link: Then she shows state code and highlights these two particular sentences in the code: An employer shall pay all wages due its employees, less any lawful deductions specified in section 91A.5, at least in monthly, semimonthly, or biweekly installments on regular paydays which are at consistent intervals from each other and which are designated in advance by the employer. 3. a. The wages paid under subsection 1 shall be paid at the employee's normal place of employment during normal employment hours or at a place and hour mutually agreed upon by the employer and employee, or the employee may elect to have the wages sent for direct deposit, on or by the regular payday of the employee, into a financial institution designated by the employee. So although I dont know what's right/wrong with what is going on...it appears that maybe my frustration is deserved and this delay should not be happening.

I dont think my auto pays will withdraw on a holiday. I'm saying that any week that my payweek has a holiday on that Monday my direct deposit is delayed by one day. So for example say today was a holiday, and my bills are suppose to go out on Wednesday. My check is also suppose to go in on Wednesday, well since the holiday is on Monday my pay will not go in until Thursday, my bills still go out on Wednesday though.

Thanks Laby.. That is where my frustration is coming from. It is so inconsistant, it's almost like the only holidays we are delayed are the holidays that payroll feel they want an extra long weekend. I'm proceeding with the Department of Labor, just to get their opinion on the matter. Thanks for all the replies.

Thanks for the replies. Our company handbook states our pay period is: "Pay Frequency is bi-weekly. The pay period begins on a Saturday and ends on Friday." So the excuse we are given is not a valid one. Employees should not be working through the weekend for that pay period. It doesn't say Wednesday is our payday, however with the exception of the two delays I already mentioned we have always been paid on a Wednesday. I would think 5 years of Wednesday paydays would mean Wednesday is our payday. Iowa Code says: An employer shall pay all wages due its employees, less any lawful deductions specified in section 91A.5, at least in monthly, semimonthly, or biweekly installments on regular paydays which are at consistent intervals from each other and which are designated in advance by the employer. Looks like the Iowa Labor Commissioner is who I need to contact about this, as far as I'm concerned they violated their own policy.

I'm not sure which forum this should be posted in, so forgive me if this is incorrect. My employer hires an outside group to do handle their human resources, payroll, benefits, etc… this outside company can be really hard to deal with but my employer does not seem to care. Anyway, we get paid every other Wednesday. In January 2011 we got an email saying since that particular Wednesday was a holiday, payroll could not be processed in time so our paycheck would be deposited on that Thursday. I called my bank and asked how direct deposit works, they said that this issue could be avoided. So from that conversation I determine that the issue is with the company handling human resources. In July of 2011 we have a similar situation come up, however no delay, in fact I got an email from the company handling HR stating that payroll can be processed in one day, so no delay would occur. In October the circumstances where again right for a delay (pay week with Monday bank holiday). However nothing..no delay, no email. In Jan 2012, another delay. So the only excuse I get is payroll cannot be processed in one day. But I have an email that says it can and two other holidays that prove it can. Monday we got an email (see below): Please note that due to the bank holiday on Wednesday, July 4th, direct deposit for your next paycheck will be delayed by one day. I know that some have questioned in the past as to why other accommodations cannot be made to prevent a delay. However, because some hourly employees will be working a full day on Friday, and potentially into the weekend, then payroll cannot be processed until Monday and the bank holiday on Wednesday will push the traditional posting date for direct deposit a day later. So now I'm just getting flat mad. How can they be so inconsistent about what holidays they do or do not delay our deposit? I have never worked anywhere that has delayed my pay check, nor has anyone else that is working for the same company. So my question is: Who do I start the complain process with? Department of Labor? Attorney General? It might not get me anywhere, but for all the inconsistencies and having an email from the source, there is no excuse for these delays. I have bills set up for direct withdraw, and these delays do me no good. Fortunately I've always been able to cover them, but some folks just can't. Any suggestions/advice would be greatly appreciated.

johnny, Thanks for the reply. I sent him a text last night to call so I could get more details (mainly dates), but I haven't heard back. I never thought of your comment though, I need to ask when those partial payments took place, and if he ever took care of the difference. Very helpful reply as I never would of thought of your response.

Doing some research on it, it looks like Iowa has enacted something to this sorts. "Judicial branch officials have entered into a contract with the Kansas City, Mo., law firm of Linebarger, Goggan, Blair and Sampson LLP to collect court fines and fees that have been unpaid for more than a year. The way I read that article you need to be 1 year behind on payments not two months of short payments. Something I'm not being told I reckon. Still maybe a consultation with an attorney might not hurt.

Not sure what forum to throw this in… I was out fishing with a buddy recently and he was telling me about a credit/money issue he had come up, so I thought I post here as someone might have a good answer for him. He got into some legal trouble several years ago and has been paying the state of Iowa $75.00 per month since serving his sentence. He told me for two months he was unable to make the $75 and paid $40. He said the next month he was able to make the $75 per month payment, and has continued as agreed. Now here is the weird thing, he said his balance was $6000 something before the two $40 payments. His balance after was $9000 something. When asking for an explanation he said they said it was turned over to a collection office and they charge a 25% fee to collect. Now a couple of things don't make sense to me, one is he is still paying the State of Iowa, not a collection company. He said he makes payments directly to the courthouse. Two he said they done nothing to collect money but have increased his fine by the 25%. Maybe he isn't telling me something, maybe he has missed more payments, maybe he has paid late/less on multiple occasions, I don't know. But how is the State of Iowa collecting on his fines as well as the fee for the collection agency that never done any collecting? I told him to contact an attorney as that might be a lot cheaper than paying $3000 to someone who didn't do anything. He couldn't remember the name, but it was a law firm that was acting as the collection agency. The more I type this the more it seems like something has to be missing as it just isn't adding up, but maybe someone here has experienced something similar.
