You need to continue the HIPAA letter program where you left off. There is no need to panic. There is no reason to believe you owe anyone any $. There is CERTAINLY no reason to pay the OC with the HIPAA letter as you never established a current relationship between the OC and the reporting CA. But I mentioned in my post that the CA came back verified. I received letters back from each CRA. Is there something I'm missing? An account from 2009 may be past the 4 year SOL for legal collection, what State are you in ,when was the date of medical service and is the amount claimed over $1,000. The DOFD was mid/late 2009, it's not even been 3 years yet unfortunately. I am still in and medical services took place in the State of Florida, the amount is not over $1000. Do I still resend the dispute letters even though all three CRAs sent me results back saying that the information on my report is verified? Also, the balance they say I owe is what was due from the original creditor. Perhaps that's neither here nor there, but no one has tacked on any other charges to my original bill, etc.

Last year, I came on here with every intention of paying my outstanding medical bill with the Why Chat process. Then, something came up and we needed the money I had set aside. So that went out the window. I got as far as removing old addresses as best as I could, and sent a dispute to the CRAs which came back as verified. Fast forward to today. I now have the money again to pay this bill. I have backdoored my credit reports and the same CA is reporting the medical debt - PROFESSIONAL ADJMNT CORP which is a local company. I have heard nothing from them for the last few years (debt is from 2009), not a phone call, not a letter, nothing. But, every month they report the debt on all three reports. However, now a new company has begun calling my home a few times week for the last two weeks. This is making me panic and totally stressed out. The company on the caller ID is MSCB, so I searched and came up with Mid South Credit Bureau. They are a healthcare collection agency with an office in my city. We have no other outstanding local debts, certainly nothing medical, so there's no other reason they could be calling. I will not talk to them but I can't understand what they have to do with this? I cannot find a relationship online between PROFESSIONAL ADJMNT CORP and MSCB. I can't DV or dispute MSCB because they're not on my credit report, so I'm stuck on what to do? I was going to go ahead and send my HIPAA Letter, money order and Insert A to the medical provider this week, but now I'm not sure what to do????

I just drafted this second validation letter. What do you think? This letter is being sent to you in response to your recent communication. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act that your claim is disputed in its entirety and additional validation is requested. As I have no account with you, nor am I your customer, nor have I entered into a contract with you, I must ask for the following information: - The Master Promissory Note for this loan is required - Complete balance information is required. All interest, fees and any other charges are required to be disclosed in their entirety up to the current date. I also checked his credit report and this loan is scheduled to fall off his report in less than a year. Currently, it is only being reported by the OC... Thank you!!!

Hi snowpuppy, Now I see in tiny, blurred font on the app: "Please read your promissory Note in its entirety before signing this section. If you do not have a Promissory Note, please call ----- and we'll promptly send you one." Then it continues, there is a statement titled "Promise to pay" but doesn't spell out anything. It's just a couple of sentences before the signature lines. I have no idea even where to begin in terms of finding out info for the state regarding this, but I'll start looking. I'm assuming it would be for the state we currently live in, not where we used to live... I'll also write them another letter requesting the MPN and a detailed balance. I honestly don't see how anyone could get away with slapping on thousands of dollars without some sort of document showing what they are for. And while I understand he received something for the money, the education, couldn't that be said for any debt? If people rack up 10K on their credit cards, they got something for it that was clearly of value to them otherwise they wouldn't have bought it. Why would the SOL be okay for a shopping spree at Nordstrom but not a degree? I'm just sort of turning that logic (or illogic) over in my head, out loud. Doesn't quite make sense to me. If that is the case then there should be no SOL for any debt when you think about it.. Anywho... Will post back with more, I'm sure I'll have more questions.Thank you!!!

We received documents back from the CA after requesting validation on my husband's defaulted private student loan. I have a few questions that I need help with: 1) This is a PRIVATE loan, the company that backed the loan is trying to collect through a 3rd party collection agency. The DOFD was in 2005. Can he be sued for this loan? And if he is sued for it, can we use the past SOL defense? That would have been at 4 years, it is now 6. 2) They included a balance sheet that began from the date of disbursement through 2005, with NO explanation as to how they arrived at the amount they are trying to collect for. The debt was bought by the backer for thousands less than what the CA is trying to collect. There is one document that shows the amount owed at the time of transfer. However, the CA's doc lists the balance at a few thousand more than that amount with no explanation. Then, it adds a few more thousand as interest (not fees). Is this standard practice, for interest to still accrue after the original lender has sold the debt off? Regardless, there is no way in hell we would pay a balance without knowing exactly what that last several thousand is exactly for. 3) There is no promissory note included, only the signed application. Was the prom note supposed to be included or is the app technically the prom note? Not sure what our next step is, I suppose it depends on what the answers are to my questions. Any help is greatly appreciated!!!

Just wanted to share my experience with AMEX for anyone who might be going through the collections process with them. I defaulted on my AMEX a while back. They quickly sent it to the law firm that handles their collections in my area and I spoke with the CA (this was pre-CB). We set up a payment that was doable for me and my husband with the understanding that the balance needed to be paid within one year. If it was paid, I would then be eligible for the Oasis program to regain card membership. After a year, we paid the balance and then I waited for the app from AMEX. It never came. Called the CA several times, each time he checked and rechecked and was actually helpful and grateful that I wasn't screaming my head off at him over it. After a few months of this, I almost gave up, but the last call a few weeks ago did the trick for some reason. I received the app, sent it in and now have a new AMEX Optima with a $3500 CL.

I am in the midst of the HIPAA process with one of my medical collections. There is something about the way this particular CA is reporting this debt though that is nagging at me. I'm wondering if the way they are reporting this is correct. Are they allowed to constantly update the debt every month to past due as of the current month? This is how it appears, except that every month the Last Reported Date is changed to the current month. Account Number: xxxxx Original Creditor: xxxxx Status: Collection account. $957 past due as of Jul 2011. Date Opened: 12/2009 Type: Collection Credit Limit: $957 Date of Status: 03/2010 Terms: 1 Months Reported Since: 03/2010 Last Reported Date: 08/2011 Monthly Payment: $0 Responsibility: Individual High Balance: N/A Recent Balance: $957 Recent Payment: $0 Account History: Collection as of Apr 2011 to Jul 2011, Mar 2010 to Feb 2011 Any insight would be greatly appreciated. It seems to me that this is affecting my credit report as if it is current, or am I completely wrong??? Thank you!

I'm a newbie here and I totally know how you feel. My husband and I have been battling with paying down multiple debts and there have been so many times when I just feel like it will be impossible to ever get rid of these debts. The way I have been handling it is: 1) Coming on here and reading almost daily. Just reading about everyone's different situations makes me feel like I'm not alone and enhances my knowledge about credit repair and successful credit management. 2) I made an Excel spreadsheet of all of our debts. Each line contains the credit card or creditor, amount owed, interest rate, current balance and maximum. This helped me see everything in perspective and allowed me to figure out which was the priority. Like a previous poster mentioned, I chose to attack the debt that had the highest interest rate first. Some prefer to hit the one with the smallest balance first to get the more immediate gratification of a payoff. Since our debts were in the $1000s and in the same range, that really wasn't going to help me. 3) I created a household budget and included payments for each debt. The one I wanted to kill off first got the highest possible monthly, the others got the minimum. 4) We are spending less and truly trying to pay close attention to what we purchase. We got into this mess over some unusual life circumstances that occurred over three years. During that time we were living on credit and loans because we had to travel so much due to an ill family member. After a while I think we got into a pattern of just charging and figuring we'd pay later. Now that we are settled, through that period and are both working, we are back to normal life now and it's easier to manage our money. That's how we got out of the gate and the numbers are slowly going down. We will continue to work our way through this and there are still many times I have a total breakdown over it (like this morning) but it passes. Ultimately, we are now in control of paying these things off and we have a plan. Baby steps. Good luck to you!

I'm having a really frustrating experience with the Oasis/Optima program. I paid my balance in full to the firm handling my account for AMEX. Have YET to receive my application and have been on the phone to the CA/firm 3 times now to let them know I still haven't gotten it. It is really squeezing a lemon me off. Last time I called was about 3 weeks ago and my rep was going to talk to his supervisor or something to make sure it gets out to me, double confirmed my mailing address. Still nothing. I'll call again this week but I honestly don't think I'll end up receiving anything from AMEX.After one more call, I give up. Can't be bothered anymore.

So far, I have: - Opted out - Removed as many old addresses as possible (damn you, Experian!) - Sent Pre-HIPAA Dispute letter to EX and EQ (TU not reporting this particular medical collection) - EX sent me a letter last week saying I am not me. - I sent EX another letter per Why Chat's instructions with appropriate proof of identity. - Received a letter from EQ today: "Equifax verified that this item belongs to you. If you have additional questions about this item please contact: CA's name, address and phone number." Then it restates the information listed on the TL on my credit report. Waiting on Experian's next response. I hope I am me after all, but we'll see what they decide...
