  1. UPDATE: I had forgotten that there was originally a little snafu with the discharge. After the court date, IIRC, I had to wait a certain number of days for the discharge. I was expecting the discharge paperwork, but instead got notice that the documentation of my credit counseling (or something like that) hadn't been filed, so the case wasn't discharged. The attorney then had to refile something and the case was discharged. I think it was inbetween the letter notifying me the case wasn't discharged and the actual discharge that the collection agency (lawyer) called me. When I spoke to the CA, I told them I had filed backruptcy and didn't have money to pay. I am leaning towards believing my private loans were discharged as it says in the backruptcy and credit report.
  2. I filed chap 7 bankruptcy several years ago. All of my student loans - federal and private (C!ti) were listed. However, I don't believe I filed to have the undo hardship to have them discharged. The trustee's closing remarks listed the total dollar amount of my debt, including all SLs as discharged. My credit report shows the c!ti loans as discharged. I'm paying on the fed using IBR and they are reporting on my credit report. I'm confused because immediately after the discharge C!ti contacted me and demaned payment in full, saying the bankruptcy automatically put me into default. I couldn't pay the full amount and about 6 months later was contacted by a CA. I haven't heard from them in over 2 years. Am I free and clear of the private student loans?
  3. Any updates from the OP or philmm787? I received a letter from them back in 2010. Per the woman I spoke to, Citi wanted a large monthly payment. I told her I could only pay $125 and had just finished bankruptcy (citi student loan). I haven't heard anything since.
  4. I took out Direct Loans and a $15k Citi Assit loan for grad school. I was unable to find a job after graduation, my husband's business folded and we had medical bills that insurance didn't cover. My direct loans were placed in forebarence but Citi wouldn't do anything, so I continued to pay $125/month. I had to file bankruptcy, but didn't realize that would send the Citi loan into default and they would demand full payment. When I couldn't pay the full amount, Citi sent the loan to a law office/collections and said I would have to deal with the collections office since the loan was no longer in their system. I called the law office and was told Citi wanted me to make payments of over $600/month. When I explained this was impossible, I had recently gone through bankruptcy and my DLs were in IBR, the office told me to suggest a payment amount, which they would then propose to Citi. I suggested $125. When I didn't hear anything back, I called the law office two weeks later. I was told Citi was swamped and it would take them some time to either approve or deny my proposal and I just needed to wait. It's been over a year and I still haven't heard anything. I've found several similar tales, including on this site, but none have gone past my current situation. Does Citi still own the loan or did they probably sell it to a collections agency? What should I do? Thanks for any advice.
  5. I'm sort of in the same boat. I had been paying on my loan, but had to file bankruptcy. Once the bankruptcy went through, they sent me a bill for the entire amount due. I couldn't pay it and they weren't offering any options. When it was sent to a collections agency, I contacted them about setting up payments. My payments had been about $124/month, but the collection agency told me citi wanted at least $600/month. When I told her I couldn't pay that much, she told me to propose an amount and they would let me know if Citi accepted or not. I followed up a few weeks later when I hadn't heard back, and was told Citi was swamped and it was taking them a long time to get through the backlog, but I would hear from them when Citi either accepted or rejected my proposal. I haven't heard anything in over six months. I don't really know what to do now.
