She has a PIF car loan that has some lates (up to 90 days in some cases) reporting on it from about 3 years ago (it's been PIF for about a year and a half and the lates are from 2-3 years). The only other derogs since BK are the medical collections, all of which are more than 2 years old.

Thanks for responding, LKH. No, the CA did not send a letter within 5 days of initial contact of DH. Also, since I do not have an acct # or anything from the CA, shall I just send an unknown debt DV? One more thing...for the past 3 years, DH has been stationed in VA, with our permanent residence in OH (I've stayed here, and we own a home here)...that doesn't matter, correct? THANK YOU!!! Kris -

Okay, here's the story: DH had a Visa acct through a local bank (we'll call them FNB...not the real initials). Opened in January, 2001...became delinquent near the end of the year that year and last payment was December, 2001. From February 2002 on, no payment was made. It was CO'd in August, 2002. Back in March of 2005, I sent a letter asking for verification of the account to the OC. At that point, it had just been sent out of their internal collections and sent to a CA for collection. Also around this time, I managed to dispute the CO off of all 3 CR. Still, he never made a payment, nor did we say that we would. The OC sent me copies of the original, signed application, and all statements showing delinquency (basically, everything I asked for in the OC verification letter). We did contact the OC after I received all of this, and this was when they told me that it had gone to a CA and they had nothing to do with it anymore. Around May of 2005, this pain in the a$$ CA started calling DH at work (actually, they called his commanding officers...he's a Marine...that didn't go so well because the CA pissed off all of these Marines, instead of intimidating DH into paying them 3X what was CO'd...it didn't go so well for them...I have a few threads on here about it). I DV'd them, reported them to the AG, they backed off...never heard of again. A few weeks ago, another CA started calling DH on his cell phone...he told them that he didn't want to talk to them about it and that I handle everything (thanks, DH) and basically, leave him alone. He also mentioned to them that it was beyond the SOL (we are in OH and CC are a 4 year SOL) and leave him alone. Well, they "warned" him that they could garnish his wages and he told them that his wife would be contacting them if it was such a problem (or something to that effect). At any rate, what I need to know is this: 1. Did we do anything to "reset" the SOL clock in requesting verification from the OC? 2. Are we actually safely outside of the SOL (meaning, yes, they can always try to file suit, but we do have an affirmative defense because of the time that it's been since any payment was made on the account)? 3. Am I missing anything here (yes, I am planning to DV this new CA, too)? Thanks, it's midnight and I worked 12 hours today, plus just returned from chaperoning a trip for 7 high school kids to DC for the weekend, so I could just about fall over. Kris

Okay, what is a realistic expectation for "dealing" on a used car?

I am looking at buying a 2006 Buick Ranier. My current vehicle is a 1998 Monte Carlo, which I've had for nearly 6 years (also purchased used with about 18K miles), paid for outright, and have about 81K miles on it now. I've only put about $1500 of maintenance into it over the six years (a new alternator this fall, tires, oil changes, etc.), so it's been a heck of a car for me. Recently, all of my family and close friends have moved out of the area, my grandmother passed away this fall, and basically, I don't really have anyone whom I'd be comfortable asking to borrow their car if mine were to die. I work two jobs, so transportation is a necessity. I'm also just generally ready for a new car (this Monte Carlo I got in college and I've staved off the desire to buy a new "grown-up" car for four or five years now) and have been seriously looking for about a year now. I also would like to get something out of my trade before it's worthless. I found a 2006 Ranier AWD with about 13K miles, GM certified, etc. I've wanted one for years, but not to pay the about $32K (base) for a new one. The dealer (whom my dad always deals with, so we have a good rapport) is asking $19,800 for it. My trade is about $3K (or, I know I could sell it for a little more), so I am looking at about $16K or so. I am already pre-approved with my bank (love Navy Fed!) for 3.5%, so I'll basically be a cash buyer for them (unless they can beat the interest rate, which is doubtful). What I would like to know is, how much can I reasonably expect them to come down on price alone? I work in jewelry sales, too, and I know that our general max discount from the sale price is 10% max. We sell stuff at a discount already, and I always try to give people the best deal up front, but I don't know the same for cars. I mean, is it unreasonable to expect them to "deal" and take another $500 off, or another $2000 off? I just want to get some perspective going into all of this (hopefully, we'll have everything ready by next weekend). TIA! Kris

DH is an active duty Marine stationed in Quantico, VA. He's been there for almost three years now. He lives with his cousin & his cousin's wife (cousin is also a Marine, seemed like a good idea at first). They have shared an apartment for over a year and a few months now. Their old apartment ran about $1100/month. DH paid $450/month for his 1/3 plus the few utilities that he may consume. The original situation wasn't even that he necessarily pay 1/3, but that he move in with them at all to help them out and help us out (they were paying less monthly and DH was getting a relatively very cheap place to live since the barricks were full and he is considered a geographical bachelor since I still live in OH). This worked well for the first year. Then, their complex announced that they were selling their apartment as a condo and gave them standard notice at the end of their lease that they would not be renewing it. The cousin's wife (we'll call her Jessica and him Brad...not real names) was *supposed* to be working on finding them a new place since she does not work and is home all day. The end of the lease term comes in April and Jessica still has not finalized arrangements for the new place. I go down for a visit, expecting to help them move because she has told DH that she has turned everything in and it should be ready that week. It wasn't. Jessica never turned anything in except the initial application. This is when the fun begins. We were scrambling around on the phone, trying to confirm all three of their credit/income information with the new apartment complex for nearly three days. We had to call CA where Brad used to live with his ex-wife, trying to get confirmation that they do not owe their old complex any money, that it was dischared in the ex-wife's bankruptcy, confirm DH's addresses on his CR (we have a rental property that his parents rent from us that reports on his CR), and address the issue of Jessica's perpetual unemployment. The new place costs more each month, so they needed some kind of confirmation that Jessica could be financially responsible for her part of the rent, etc. It was a mess. Jessica, though, HAD to have this new apartment because it is huge, brand-new, and beautiful. She also HAD to have the three bedroom, not for DH's benefit so that he would have more room, but because she had one of her friends living with her under the table, who had given her an upfront sum of money for the three months she was going to school down there (approximately $1200 is what DH and I think), so that she could still provide her with an illegal place to stay. Now, DH's rent is going up to $550 so that she can enjoy all of this. We don't complain, in fact, we pay the $120 to rent the U-Haul because Brad's friends NEVER show up to help move all of the crap from the apartment. We could have fit DH's stuff and OUR furniture (which we bought before he moved in with them and they would have none of if not for us) in his and his friend's trucks to move, but they had all of these drawers of clothing (because, no, she doesn't pack them, she just pulls the drawers out of her dresser and piles them up) and other useless crap. Also, Jessica has a six year old from a previous relationship who lives with her during the summer and who she ships back off to her mom and dad at the end of summer every year. Surely, she needed to ensure that there would be a bedroom available for her to live in for the THREE months out of the year that she takes care of her. Back to the initial move-in. Because Jessica has no money and no job and bad credit, she does not qualify to move in. It's down to the last day that they have to be out and she has to provide the new complex with a $1245 deposit to move in. Guess who pays it? DH & I, with the understanding that they will either pay us back in installments, excuse DH's rent or part of it for a few months until we have re-cooped that money, or we will get the lump sum back from the complex at the end of their lease. The first two months in the new place are basically rent-free. DH & I paid HALF (not 1/3) of the pro-rated rent to move in (approximately $400). Their next month's rent was free (promotion from the complex, but they take that money if the lease is broken), and the next month, they had a pro-rated refund of about $800 from the old complex to apply to that rent (plus, DH gave them $250 that month, based on his portion of the pro-rated refund). Fast forward to this month. Brad and Jessica leave to take Jessica's daughter back to her parents about 22 hours away, stopping to see Brad's family and do some sight-seeing on the way. On returning, they are planning to honeymoon in VA Beach for a few days, too. They are driving her car because his is in the garage because it might get repo'ed soon. DH has been answering collection calls for their cable for the last two days and got a notice that their electric bill is over $900 (last month's portion is $120 of that, so it's not that they have just left the lights on a lot this month). He also found a pamphlet to a new apartment complex that is tax-credit based on income, which they would qualify for on their own, and last week, they mentioned something about getting into base housing. The utilities are not our problem. The lease is. DH is pissed because we are giving them money every month and it's not getting put toward the bills. Obviously, they are not paying the bills, but they are going to Pier 1, IKEA, and the mall whenever she feels like it. He spent $170 on groceries last month and he does not eat at home. Jessica always wants to complain that he doesn't pay enough of the bills, but he pays his share and they abuse the money. DH & I would not have a problem with paying an extra $100 a month because it would still be cheaper than living on his own, but that $100 is going to get pissed away on something else. He has tried to talk to them on several occasions and things seem okay for a while and then some other bomb drops. He is waiting to call them tonight because he called her mom's house and they are at a baseball game until 11 pm our time. The problem is now that they have nothing to lose if they leave. They have already ruined their credit, they are up to their eyeballs in debt, and they don't care if DH gets screwed. He has good credit and we'd be stuck paying out of pocket for this damned lease, plus losing the $1245 we put down, plus the "free" month's rent. All three of their names are on the lease. They wouldn't care what happened to us, obviously. Yes, we could sue them, but that would all be after the fact and we have bank statements showing withdrawls, but sometimes, we paid them cash, sometimes in check. The burden of proof would be on us. AHHH!!! Please help if you have ANY input. DH wants to go talk to JAG tomorrow and to his apartment because he's not sure that they paid this month's rent before they left, or if they were just going to leave that up to him (although they were sure to collect his part of it when they got paid).

To add fuel to the fire, I got a letter from EX yesterday responding to a BBB complaint. It's a copy of their letter back to the BBB, saying that they are looking into the complaint. I sent the complaint nearly a year and a half ago. Something is going on here...WTF??? Kris -

We randomly received a hard copy of DH's EX CR in the mail the other day...didn't dispute anything, didn't request it. It just showed up. About 2 years ago, we disputed an unpaid CO with EX. They kept giving me the "previously investigated" BS and I wrote letters to everyone I could think of about how this was illegal. Low and behold, one day, EX sends a letter saying that the account has been DELETED. I still have the letter, I have copies of everything, as a matter of fact. A CA tried to collect on it after it was deleted, but after a DV, we haven't heard anything in over a year. Then, this copy of DH's report comes in the mail. Everything looks fine, nothing out of the ordinary, except that on the front page it says this: "OTHER ITEMS DISPUTED ARE NOT CURRENTLY DISPLAYING ON YOUR PERSONAL CREDIT REPORT: (OC'S NAME & ACCOUNT #)." WTF? It is not reporting on the CR, but I thought EX had DELETED it. Should I be writing letters to them, or is this nothing to worry about (btw, the debt is SOL)? DH is ready to sue someone, but he doesn't know who (it's cute because two years ago, he had no idea what was even on his CR, now he guards it like a hawk). Advice, please? TIA! Kris
