  1. any legal students here?
  2. i am going to go back and reread the "letters" area but in the meantime, if any of you have advice/input that would be great. the OC is a private person, not a company. however he does buy/sell a lot of land. obviously he does not think of me well at this time and i do not want to get into some sort of squabble. account has been in collections for 3-4 years. i would like to contact him directly and find out the details. dealing with the CA is pretty much out of the question.
  3. so contacting the OC does not restart the SOL? what does? payments? i would LOVE any info/ideas on contacting the OC and figuring all of this out.
  4. thanks for the replies. i dont quite know how or why. i asked previously if it was a good/bad idea to contact the OC. i was not sure about the SOL and which state would apply. oddly enough, i think the OC might have pulled a fast one on me. this spring i recvd a call from a texas # i didnt recognize. no message. i couldnt take the call at work so i called back and left a message, saying that i had recvd a call from this number, etc... (thinking it might be something important from tx) and guess who calls me back? the OC. he said theres no way he called me as he was on a plane. (i hadnt spoken to him in 2-3 years) so i wonder if he did that to try and restart the SOL?
  5. the land does exist, i drove by one day in the rain. good question about the foreclosure, i have no idea. it is just under an acre, not developed, i think that may have something to do with it. i dont know.
  6. a while back i posted about a large debt that i have and it is all very convoluted. it involves a piece of land i purchased over the internet. i was living in maine and purchased a piece of land in texas over the net. later moved to texas. have still never set foot on the land. after 1 year my medical problems increased and i stopped paying on the land. later i was sent to collections. i attempted to reason with the CA (Rickenbacker) but they were obnoxious, would not accept payments i could afford, could get nothing in writing other than collect letters. they would not even give me a way to mail payment, saying they ONLY accept check/CC over the phone. a few years later the debt has almost doubled it seems. i dont know if this is interest or taxes (someone just brought that to my attention and i have no idea) i am really frightened and dont know how to start making this right. i think i need to hire a lawyer to help me understand what i am up against. any ideas? what sort of lawyer do i need? real estate? debt?
  7. denied for the decrease in interest as well. she said my card was "ineligible" at this time. how can these people talk down to us so easily? we pay their salaries with these outrageous interest rates. i mentioned that i understood that they were no longer doing customer initiated CLI, so i asked how does it work? random? she said "well, not random." i asked if she could explain further and she just stammered and kept going over the same things she'd said before. ugh.
  8. well if i cant get a CLI, i will call back tomorrow and ask if they can lower my interest rate. anyone know if they are doing it now or justwe are just supposed to wait for it to randomly happen?
  9. get this...i just called and a supervisor answered. said that they are unable to do CLI over the phone and havent for the last 5 months. obviously this is false. i got his id number, not that it would be good for anything...
  10. 1) i have "opted out"...now to remove my old addresses from CR, do i need to cal/writel or can that be done online? 2) obviously dealing with the CA isnt a good idea. should i try to contact OC?
  11. omg. i never even thought about taxes. uh oh. i have been "assuming" this whole time that the OC essentially "took the land back" and i was to pay out the amount of the original purchase. lord. i have no idea how to find out the details without contacting the OC or DA. i am an salamander. i'll be honest, i have pretty much buried my head in the sand about this for 2 years now. i have an anxiety disorder and for a while, this was more than i could even consider thinking about.
  12. i too just started repaying some older debts on my CR. they are valid. i was trying to do what i thought was the right thing. before finding this board, the majority of us are not aware of our rights and dont know what steps/action to take. most of us didnt even know we had options aside from paying or not paying. i have been sending these two creditors $50 a month, as that i all i can afford. so let me ask you guys this (i have read the newbie/intro stuff but still am not clear on some things) if i understand correctly i need to validate, and get some sort of agreement from them, in writing, that if i pay the debt they will either remove from my credit report or change the status to paid in full, or something less negative. correct?
  13. Married, Children, Husband active duty military. I have, on my own, incurred a large debt and I want to correct it. I have gone over my credit report, disputed the ones that were not valid, and contacted the ones that were, and have been making payments. I read where someone had posted the importance of validation letters. I read thru that file and am not sure which apply to me. What I am wanting is for them to verify whom I am paying and what amount, in case the account is sold to another company in the future, I want to protect myself from having to pay again. Any ideas? Wording? Now here is my BIG problem. 2004, While living in the state of Maine I purchased a small piece of land in Texas. (not one of my best decisions) I made payments on it for about a year. We moved to Texas but I had never seen nor stepped foot on the land. After a year I got very sick and stopped paying. 2006, I was sent to collections for $6000.00 The CA is Rickenbacker, they are just awful. Most agents I can hardly understand. I called them and told them that I wanted to make good on this, asking for help in coming up with a payment plan. The agent refused to accept what I could pay. I asked for an address to send a payment, I was told that there wasnt one. I asked for a way to make payments online, I was told that there wasnt one. I was told twice that the only way that they accept payment was over the phone via credit card (yeah like i want to get into more debt) and check over the phone. My husband has said NO to that option. The interest on this account is huge and as of now, I owe $10,000. I would happily make payments to them every month but I am afraid to contact them. Afraid to start the harrassment all over again. And I just learned about the SOL. I dont want that to start all over again. (SOL=would that be the state I live in or state i lived in when i was sent to collections, or where i was when i originally made the agreement?) I am scared to death that they will try and take me to court, or garnish wages. Any ideas would be appreciated.
  14. my spouse is active duty military and has a security clearance. i am worried that because of my poor financial situation/debts this can affect his clearance. neither of my large debts were in his name, incurred by him, etc...
  15. a friend of mine works for Experian. she said that the only company they recommend is Greenpath.
