  1. Been receiving private calls from Premier Services. Answered and they are urging me to call RG & Associates at a 323 number. Called RG & Associates and they are a CA with an in-house attorney. Person I spoke with said they needed to verify my address so they can send me the lawsuit against me with court dates, etc. Said the Attorney has the file on his desk and may accept a settlement. Came back and said 1100, 500 less than original amount. Account opened in 2007. Stopped making payments in Nov. 2009. Original balance was in 300 range. Cap One no longer has Orchard Bank charge offs .... That's what HSBC said. They took them back. Customer service rep could pull up my account. Wanted to take a message and have the back office call me in 3-5 days. I know I owe the original debt and would like to work something out but RG & *Associates won't provide verification of debt. Said the mailed three letters, I never saw them. Does anyone have any knowledge about this? Has anyone heard of RG & Associates or Premier Services? Couldn't find anything on either of them. RG told me they were going to send the certified court paperwork if they don't hear back from me by Monday. Said the Attorney hadn't pit the lawsuit through yet. Help and thanks in advance.
  2. We made the mistake of getting an account through Conn's a couple of years ago. We pay our bill every month. It is due on the 20th of each month. So, in December it was due on the 20th but I couldn't pay it until the 19th of January. When I called the representative offered me an extension in exchange for an interest payment. I made a payment to cover the extension and specifically asked if this would prevent our account from going 30 days past due. I was told it would and that the payment would post immediately. I just randomly checked my husband's credit report this morning (it's his account) and saw they reported him 30 days late. I have submitted dispute with Conn's as well as Experian (where I found the derogatory information). Do I even have a case? I am VERY cautious about when I pay my bills. I had a baby in January so we did go through some financial hardship for a while prior to and after, but I am very careful not to get reported to the credit bureaus. I am so upset about this because we are both desperately trying to preserve the credit ratings we have. We are still struggling from past debt that was created before we were married six years ago. My credit still isn't very good and I make our car payments, mortgage payments and credit card payments every month.
  3. My husband and I have several credit cards. A couple of mine are slightly over the credit limit due to annual fees (that I was not aware of ... or ... forgot about). Will the credit card companies work with you if you want to pay off the card in full? Let's say you owe $800 and you offer them $500 or $600. I am not trying to get over by any means, but I was just thinking that most things in life seem to be negotiable (buying a car, etc.) so I just thought I'd try.
  4. Thanks! I guess I have to ask ... what's the point of a PG then? I opted not to sign one when I applied for the accounts, so because my business was so new they required a copy of a utility bill from my home address to verify residency (I guess). So if I don't sign a PG I'm still liable (as a sole proprietor) and if I do sign a PG I'm still liable (as a sole proprietor).
  5. Thanks, Greywolf. Actually, I have tried to get Citi to recall the Staples account and they said no can do. I have not spoken to the new agency (Client Services). I had such a bad experience with United Recovery Service when I was really trying to work out a payment plan. I did not put my personal social security number on ANY of the business accounts, and I did not agree to personally guarantee any of those accounts. If that were a condition of approval I wouldn't have gotten the accounts, because my personal credit has a lot of old collections (medical and past stuff) on it ... I know for a fact I did not, but United Recovery Service had accessed my personal file and had all of my information available. But it is my understanding, from reading things on this board, that regardless of whether or not I PG'd anything I am still liable. I used my Tax ID number for all accounts. I was operating as a sole proprietor. I have read about Client Services on Budd Hibbs' website and they seem like they are difficult to deal with as well. I just want to setup a payment plan and I don't want to get screwed in the process. But with being due in three weeks I don't need to get myself all worked up and angry.
  6. I'd like to add that neither of these CA's have been aggressive like URS. URS called 5-6 times a day. These other agencies call every week or every few days. I hardly get any calls at all at this point. Is this a bad indication?
  7. I am due to have my first child in three weeks and I am about to go crazy! I had a home based computer training business with several lines of credit. After the business stopped I was unable to keep up with payments (one was actually closed by Citi). I had an Exxon, Office Depot and Staples account through Citi. I was able to catch the Exxon account before it went into collections and I'm currently setup on a no interest, no more late fees, payment plan for the next 60 months. However, the Office Depot account is with a CA and the amount is a little over $500. The Staples account was with United Recovery Services (URS) and was transferred to another agency within the past month or so. I believe the name is Client Services, Inc. or something like that. It has a balance a little over $1,200. There is also a Dell account that is with a CA and it is for a little over $1,100 I believe. Since joining this board a few months ago, I have learned to stay off the phone with the CA's. But, I can't seem to get any guidance as to what rights the CA's have when it comes to business credit. All people on here keep saying is they don't have to follow the personal consumer laws. I have searched this site up and down and I don't see anything that tells me what the CA's can and cannot do, what my rights are, and how I should handle collections issues. I have received letters from all three CA's regarding these accounts, but haven't responded because I really don't know what to say. I can't afford to pay any more than $20 or $30 per month for each account. I actually tried to work with the initial CA (URS) on the Staples account but all they wanted to do was argue, put words in my mouth, and demand payments that I couldn't afford. I am tired of this being over my head and want relief. I live in Texas so I know they can't garnish my wages, but I am very afraid they will try to put a levy on my bank account (which is jointly shared with my husband). We have a small stash saved away at home but our paychecks come in there twice a month and that's how we pay our bills. I cannot afford to make a settlement on anything at this time. My questions are: 1) Can ANYONE tell me what the laws are regarding business debt collection in Texas? 2) What is the best way to get a sensible payment plan with the CA's without dealing with them over the phone? 3) How can I make sure I'm not being raked over the coals when it comes to making arrangements? 4) For the CA's who demand your bank account information to setup a payment plan, what should you do? I contacted Citi about a month ago and the guy told me the Office Depot account had been sold to the CA, but the Staples account had not. I asked if I could make the payments through them instead of working with the CA and he said I must work with the CA. Is there any way around this?
  8. I have also asked many questions about business credit laws vs. personal credit laws and never seem to get much help. I have searched this site and can't seem to find what I need. There is a lot of helpful information on here, but there's so much and I think that's the reason I can't find what I need. All people ever tell me is that CA's handling business accounts don't have to follow the same rules as they do for personal accounts, but nobody ever tells you where to find the information on what CA's can do when it's a business account. From what I understand, there are supposed to be several people who are very knowledgeable about this in the business forum but again, I get no help. Good luck!
  9. I called and they allowed me to make my normal monthly payment. There won't be any over the credit limit fees since the fee is from the bank (for the annual fee). They were actually really nice about the situation, but wouldn't waive the annual fee.
  10. I had a car repo'd in 1996. I was like 3 or 4 months behind and that point they wanted payment in full for the vehicle (not the past due amount, partial payments, etc.) ... and that was their only option. I don't know what the laws are for each state, but it does seem dumb that they wouldn't accept the past due payments and return the car to the buyer. They kept telling me to try to get a loan through a credit union or another bank, but once you're behind and it's reporting to your credit it's merely impossible to do so. Nobody will give you a loan and if they do you will pay a pretty penny for it. I really don't understand why the banks won't try to work with you, especially if you're able to come up with the money in a short time after they repo the vehicle. What good is the car to them? I realize they've gotten their merchandise back but it's my understanding that they sell the car at an auction for way less than you owe and then try to collect the difference from you. I am sorry you are going through this. I've been there before. You will get another car but it will take time. You will most likely have to go to a tote the note place, or pay an extremely high interest rate until you can get back on your feet. My suggestion would be to buy a cash car, something to get you from point "A" to "B" until you can things in order. I wish you the best of luck!
  11. I have an Orchard Bank card through HSBC. I logged into my account on Monday to see when the bill was due and I noticed my account was overdrawn by $61.00. I almost had a heart attack because I never use this card. When I looked through the transaction history I saw the annual fee of $79.00 which had been deducted from my available balance and left me short. My monthly payment is usually $17.00, but they are showing it as $70 something and some change. I cannot afford to pay a minimum payment like that this month. It is due today. I am planning to call them to see what I can do, but does anyone have any experience with this? Is there a way to renegotiate the minimum payment? I absolutely can't afford to make the payment this month. Is there anything specific I should ask for? If they do allow me to make a lower minimum payment will it report as late on my credit report?
  12. I have asked many questions on this site about business debt and I now understand the laws for personal consumer debt do not apply to business debt. However, I have searched this site up and down and can't seem to find anything concrete about business laws. I've looked in the Business Credit forum as well. I have tried to Google the information with no luck. Where can I find concrete information on business debt? Specifically: 1) What laws the CA has to follow when trying to collect a business debt? 2) Does the "STAY OFF THE PHONE!!!" rule still apply to business debt? 3) What do you do if they refuse to send you verification of the debt in writing? 4) What happens if they call you on a daily basis but you just ignore the phone calls? How long will they continue to call with no response? 5) Can a CA sue you just because you're a sole proprietor even though the debt was under the company name and you only used your Tax ID Number? 6) Lastly, where are the links to find out information specifically about business debt? I was a sole proprietor and I did not provide my personal SSN on ANY of my business debt. I know this for a fact. But one CA has pulled up my personal credit history. I really want to know what my rights are, if I have any, and what's the best way to deal with these CA's. Thanks!
