  1. We surrendered our house in the paperwork during our BK7 filing back in December and we were discharged last month. We have not received anything from BOA regarding the house and we would like to know if we can just contact them to see if we can go ahead and turn over the keys. Our lawyer will not return our calls so we cannot ask him. We are not sure if that is a good idea or not.
  2. We stopped paying on our house in July 2009 and moved out in December 2009. We currently rent from DH parents and plan on buying the house in a few years when able. The bank has not sent us any foreclosure paperwork and I'm wondering why it's taking so long. We filed BK7 several months ago and should be getting our discharge in the next couple months. We surrendered the house when we filed BK. It's with BOA - formerly Countrywide. What is taking so long, we just want it out of our names.
  3. We are in the process of a Chapter 7 and will be letting go of the house, we've not made a payment since August. We have already moved into another leased house and will have the rest of our stuff moved this weekend so the house will be totally empty. We are having the utilities shut off by this weekend and will be turning off the water and gas at the main sources just in case. What do we do with the keys to the house...I'm assuming they will change all the locks once the bank takes it over. We'll be keeping a set just in case and will be leaving all pertinent info (appliance handbooks, ect) in the house. Should we call the bank and tell them what is going on or just let them find out when the ch 7 is officially filed which should be done this week or next at the latest. Basically we just want them to take it back now so it's out of our hands.
  4. My husband and I are going to file for BK in the near future and we know we can't keep the house. Has anyone ever done a deed in lieu of foreclosure? We're going to tell BOA (when is in question) that we are definitely going to have to walk away if it comes down to that but I'm hoping they might do this as an alternative to foreclosure.
  5. Ok, my husband and I are going to file BK - just have not decided which route to take, just met with hour lawyer yesterday who gave us our options. We are going to step back and really think about it for a few days before we make any rash decisions. The BK is a done deal decision-wise but the house is our main question to be answered. We hoped to move in the next couple of years anyway back to his hometown - only 20 minutes down the road but excellent school system (main reason looking to move). Also DD is in a private school but it only goes to the 5th grade - around $500 a month, she is in 3rd grade and has gone to this school since K5. The school system we are in pretty much blows. Our lawyer said the private school thing could be a problem when it came time for the meeting before the judge. My inlaws said they would pay the tuition if need be so that would be off our plates. We are thinking of just moving to the town we want to live in and renting a house long term until we can purchase one again - we have found some that are renting for hundreds below what our current mortgage is. Should we just walk away and start fresh? We have tried every way possible to pay these debts but are just digging a hole deeper every month - we've even gone to consumer credit to get caught up. But we have over $23000 in CC dept and over $40000 in student loans (we know those are ours until death). Right now we just need some relief because the stress is killing us. But what exactly would happen if the house did eventually sell, especially for less than what our mortgage is? We owe $200K on it - bought in 12/2007 and have pretty much no equity yet. Will they come after us for the remainder and what are the chances of that happening? We're worried that we'll get out from under all this and then in a year or two we'll have a lawsuit against us for $50k or more.
