I sent out the Pre HIPPA letters for my husband and I am about to start on my own report. I have two questions.....at what point would I use the SOL letter? Many of my medical collections are far past their SOL. Second....Experian has kicked me and my husband out of the backdoor and won't give me any reason as to why. I just filed complaints with the CFPB and the FTC regarding information their CSR gave me about it but it doesn't change that I can't get back in. Any suggestions?

The "SOL" letter is used with NON MEDICAL accounts, it is NOT a part of the HIPAA letter program-- 2 completely different programs.

I thought I was keeping them in one thread. I started this thread to keep all of my posts in one place. I was asking because of this http://whychat.5u.com/ltrcavalhipaa.html and at the top it states .... Use this letter to notify the agency that the debt is beyond SOL, or is invalid for other reasons, and subject to the HIPAA privacy laws. The HIPAA part led me to believe that this was part of the HIPPA letter program. My apologies.

The phrase in the medical DV is

on any account that may be time-barred

 

This is a "generic" warning, in the actual SOL letter program the statements are specific. Here is a link to the SOL letter program so you can see the difference

There is a "generic" claim of obsolescence in the initial dispute letter to the CRAs in both programs.

So I would do the Pre Hippa (already done), wait for the results and then use this letter if my accounts are SOL or no?

NO!! You send the initial dispute letter, if verified you send the medical DV and then re-dispute with the follow up letter. There is NO REASON to use a "SOL" dispute on a medical account. The ONLY time you need to worry about the 4 year SOL on a medical account is if it is a LARGE VALID AMOUNT and you are vulnerable if you are sued.

Pre HIPPA letters went out May 21st. I sent them certified only per your instructions. Do I wait 30 days from when it says they received them online to do anything further?

 

Here are the results. There were 5 accounts. TU deleted all of them. EQ and EX have not touched any of them. Both of them are showing "investigation in progress" on each tradeline though. None of the CA's have sent anything in the mail to me. My next step will be the COLLECTION AGENCY VALIDATION/DISPUTE/CEASE AND DESIST letter and send follow up disputes to the CRAs at the same time, correct?

Oh I will wait for their results. I know that EX is done with 2 of them because the "investigation in progress" line is gone. So I will just put the accounts that they don't remove on the DV letter, correct?

So I have one account that is staying on EQ and EX and one account that was reinserted by EQ. I sent them the reinsertion letter with a copy of the letter from the CA stating that they were removing this account from their records. What is my next step for the account that is sticking? The LETTER TO COLLECTION AGENCY MEDICAL ACCOUNT DV/SOL/CEASE/DESIST to the CA and I do one for each CRA they are reporting to then I wait for confirmation via USPS website and I send a copy of this letter with the followup letter to EQ and EX, correct?

??? No, you are correct about sending one letter to the CA ( medical DV) for each CRA they are reporting to, in the same envelope.

You can MAIL them all to each CA in ONE envelope with one certified mail #

 

You want to be able to send a copy of the medical DV to the CRA with the follow up dispute.
