This is what I have done so far:

 

- Opted out

 

- Obtained credit report directly from CRA by mail

 

- Removed all of the old addresses except EX which had addresses tied to negative TLs

 

- Sent pre-HIPPA medical disputed to three CRAs TU deleted the TL, EX & EQ verified it

 

- Sent medical dispute validation letter to CA

 

- As soon as received proof of delivery to CA, sent follow up dispute to CRA

 

- Received a generic response from EQ & EX to directly contact the CA for the TL.

 

I have not received anything from the CA. It has been more than 40 days and they did not respond to my medical DV. Therefore, I am not able to document a current relationship between the health care provider and the reporting CA. What should I do now?

The next step is to file a complaint against Eq and Ex with the FTC and the CFPB

Double check via the "back door" with Eq and Ex to make sure that the accounts have not in fact been deleted and to see if they are being properly reported as disputed by consumer, if they are NOT notating the account add that violation to your complaints.

I am not sure about the exact date for the medical service but from what I remember it is from early 2008. This account was assigned on my credit report on Jan 2009.

 

I double checked both EQ & EX using backdoor and I can CONFIRM that the medical TL is still on my report. Both of them report under the comments section as "Consumer disputes"!

 

With your blessing, should I move forward with FTC & CFPB complaint? I will try to get this done by tonight and let you know if I have any questions. This is my first time filing a FTC or CFPB complaint, **nervous :)

Nothing to be nervous about.

 

Make sure you do each of your complaints first in word or notebook as once you submit them you do not have a copy.

 

As soon as you have a confirmation response from each, paste that response to the TOP of your complaint.

 

When you send the copy of the complaints to Eq and Ex you can put both complaint copies into one envelope with one cover letter to each CRA

UPDATE ----

 

 

I received the following final response from Equifax for the CFPB complaint, I am still waiting for final response from Experian:

The Bureau of Medical Economics Collection was verified in Mr. XXX's current name, social security number and date of birth. Mr. XXX may contact Bureau of Medical Economics at 326 E. Coronada Road Phoenix, AZ 85004 or (602) 2521-3469 for additional concerns or questions. The results of the reinvestigation were mailed on XX/XX/20XX."

Wait until you get a response from Ex.

Did you, in fact get the results of the reinvestigation that they say was mailed to you??

If Ex also verifies, then file a complaint with the BBB of Arizona, the CFPB and the FTC against this CA. your complaint should relate all your previous correspondence and state that documentation of the alleged account was never provided to you despite numerous requests.

 

Sometimes it takes a stronger approach with some of these CAs

When you send the copy of the complaints to the CA you should also state that in addition to their failure to identify the account as to the date of service, the name of the patient and the name and address of the alleged provider, that they are beyond the legal date for collections, as the statute of limitations in Arizona has a 3 year limit and any claim would be time barred.
