I need a little help here guys, I was just told by my wife's title company that is handling her short sale on the home she bought before we married and until this day has remained under her sole name, after 6 months she finally was able to get approval the short sell the home which is in its final steps now and due to close on the 25th of this month.

The title company just called my wife to tell her that I need to sign a quit claim deed even though when I sold my condo on a short sale myself about a year ago this was not required, my wife was not asked to sign anything since she was not on the loan.

 

My wife refused and they told her this will be a big problem and could possibly seriously affect the closing if it was not signed. I am concerned that by dong this I will be somehow connected to her property which I want to avoid since I am looking at buying a new home in my own name in less than a year.

 

We are in the state of Nevada BTW

 

Please help as I don't know if I should sign this

i'm confused, you said the title company told your wife that you need to sign the quit claim then you say your wife refused. do you mean you refused to sign? or she's refusing to let you sign?

 

before i was divorced, i refied my house into my name only and my wife had to sign as well but her name was on stuff. while im no legal expert, from what you say if you dont sign the house doesnt get sold. period. regardless of that im pretty sure it's ok for you to sign, thats really the answer to your question. do you want her house sold or not? the title company/bank hold all the cards. if you dont sign she has this house forever apparently and something tells me neither of you want that.

 

that being said, you only become part of a property if you are on the title or the loan. and i dont know how a quit claim deed would make you part of a home being sold to someone else

By virtue of being her spouse, you have some dower rights. The title company will insist you waive them before the sale, so the buyer can get a clean title. It's no big deal.
