Sent WhyChat's Pre HIPPA dispute to the CRA's and all three failed to complete their investigation within 30 days.

 

All 3 disputes were delivered on Feb 22, 2013. Experian sent me a letter stating their investigation was complete and to

see the results below: It says still pending and projected completion is April 10th. I have included the snapshot below.

I do not remember anywhere where it says they can do that?

IIRC, they have to send the results of their investigation within 5 days after the 30, correct?

 

I have not received anything from Equifax or Transunion.

How old are the accounts ( dates of service)

 

Are these left over from insurance??

 

If so do you have your EOMBs

Well--- it depends on what the results are when the investigation is complete and you have a response from the CRAs.

 

If the accounts are deleted, you obviously would need not do anything further.

 

If the accounts are NOT deleted and you receive a response from the reporting CAs that matches the data on your EOMBs, you can pay the OC with the HIPAA letter insert "a".

 

If the accounts are NOT deleted and you receive NO response from the reporting CA, then you need to send the reporting CA the medical DV and re-dispute to the CRAs with the follow up dispute

 

The fact that they are reporting, even if your EOMBs indicate that they are valid debts, does NOT automatically mean that you can pay the OC as the reporting CA may not be the original assigned CA and may not have any current relationship with the OC.

Well--- it depends on what the results are when the investigation is complete and you have a response from the CRAs. It has been 40 days since they received my Pre HIPPA dispute and the only thing I have received is the above posted letter from Experian.

 

If the accounts are deleted, you obviously would need not do anything further. Crossing Fingers

 

If the accounts are NOT deleted and you receive a response from the reporting CAs that matches the data on your EOMBs, you can pay the OC with the HIPAA letter insert "a". Haven't received anything from the CA's as of yet....

 

If the accounts are NOT deleted and you receive NO response from the reporting CA, then you need to send the reporting CA the medical DV and re-dispute to the CRAs with the follow up dispute Should I do this now?

You need to start from scratch and go step by step:

Come back to this post with the results of your NEW initial disputes for further individualized instructions.

 

Be sure to tell us if any accounts were deleted with your new dispute and if they were deleted from ALL reports.

Also the date of the medical services

 

Original health care providers are not allowed to report directly so you will NEVER see an OC health care provider on any credit reports.

 

The HIPAA letter program IS complex, that is why we ask that you keep all your posts in one thread and do not try to copy advice intended for someone else.

Update:

 

12/6/13 - Sent Medical DV to CA (Professional Finance).

12/9/13 - Professional Finance Received DV.

 

No Response from Professional Finance 30+ days later. They did put the acct in a dispute status with the CRA's.

 

12/9/13 - Sent Follow Up Dispute to EX, EQ, & TU

 

Experian Received the Dispute on December 19th (10 Days after I sent it)

Equifax Received the Dispute on December 12th ( 3 Days after I sent it)

TransUnion Never accepted the dispute and it has not been returned. I have no clue where it is. Just shows as "Departed Sort Facility" and disappeared.

 

I received a letter from EQ on Dec 31, 2013 stating "We have verified that this item belongs to you."

I received a letter from TU on Dec 27, 2013 stating "We are currently investigating your dispute and will send our response in the mail"

I received a letter from EX on Dec 24, 2013 stating "We are responding to your request to investigate items on your report. The address you supplied is not the same as the address on your report. As a security precaution, we must verify your mailing address."

 

Where should I go from here?

Where should I go from here?

 

I have been at the same address for 20+ years. About a year ago, I had all variations of my address deleted. The address on my EX report is my current address. Hasn't changed on there. I just wonder if this is the stall tactic they use?

Possibly, send them the follow up dispute with the proof of your address and file a complaint with the CFPB regarding their salamanderic delay tactics.

 

Of course-- double check your report to see if someone elses address got mixed in with yours and double check the inquiries for signs of ID theft
