I texted my ex this morning about what time he would be getting the kids. At 5:59pm, I get a reply stating "I won't after thinking long and hard this week I have decided to take a job out of state." We'll it is now 8:47pm and he still isn't here for the kids and he was supposed to get them at 6pm. Is that text enough to get emergency primary custody of the kids? I think my lawyer is out of the office to tomorrow, but I have left a message for him.

Seems like your "attorney" is always out of the office when a crisis hits.

 

If you really want custody, and he has "abandoned" them via text, then if your normal attorney can't get his butt in court TODAY (or send someone to file the petition), I would think you would find an attorney who could file an emergency order TODAY.

My attorney was available today and is in the process of filing the paperwork for custody now. I'm thankful and relieved, but still in shock somewhat I think.

That's great to hear. I hope this is the end of all the drama for you all.

The attorney has filed the paperwork, but they do not hear custody matters until Thursday in this court. So I will go to court this Thursday most likely. I do not have a time yet, but I will be calling for that tomorrow afternoon. As far as the father, he supposedly wants a "break" according to his mother and wants to resume primary custody of the kids in a few months when he gets back on his feet. The kids do not want to go back to him, though.
