So I currently have two collections from the same CA, SA-VIT Enterprises (they sometimes just go by Savit).

 

One of them is $90, opened on 6/1/2012.

The other is $280, opened on 12/1/2011.

 

Now, I don't deny that these are legit collections. They were both caused by me just missing out on paying them. But I still want to get them off, and will even pay them in full since it's not much money.

 

I went ahead and removed old addresses from all CRAs, simply by giving all 3 agencies a call. I already verified that they are indeed off the reports.

 

Then just yesterday, I sent off the dispute letter listed here to all 3 agencies--> http://www.whychat.5u.com/hipaadisp.html

 

Next step I guess is just to wait until about the end of next month to see how they respond. I will more than likely have to send the letter listed here--> http://www.whychat.5u.com/hipltr.html

 

I will update as new things arise. I guess I just wanted to write this out here, just to make sure I'm doing everything right. Feel free to respond, lol :)

So I checked my report yesterday...

  • I now see that both of these collections were already removed from TU. Don't know if it's a temporary thing, or for good, but they are completely off the report right now.
  • Equifax shows it as customer disputes, investigation in progress.
  • Nothing has changed on Experian yet.

 

I also got an email from Equifax today asking me sign up to get immediate responses about my investigation. I didn't sign up though, because I still rather them just send me actual letters in the mail. I assume they still have my email address from when I did an online dispute and got rid of misspelled names, old addresses and phone numbers.

Checked again today, now Equifax still shows the accounts as:

 

"CONSUMER DISPUTES - REINVESTIGATION IN PROGRESS

MEDICAL
Unpaid"
...but it doesn't show the CA name anymore. I find that to be really weird.

WhyChat, I have a couple questions for you...

 

First off, like I mentioned above, only TransUnion removed it from my file. Both Experian and Equifax sent back letters saying that they have verified the accounts and that it will remain on the reports. So with that said, I should be able to go ahead and send the payment with the letter as listed here, using insert a? --> http://www.whychat.5u.com/hipltr.html

 

Also, on the page it says, "Please make sure that your payment is in the form of a bank cashiers check or bank money order" ... Can a Western Union money order work? Or do I have to actually go to the bank and get one?

 

I should send these CMRR, correct?

 

Or am I going about things all wrong and should do something else?

 

On a somewhat related note, since this dispute has started, my Equifax score has dropped considerably for no real reason. Both Experian and TU report at 647, and Equifax is reporting at 575. I called them, and the lady who I spoke with said (without even looking at my account) that when an account has disputes on it the score drops. Is this normal? Just never heard that one before.

No, unless you received a response from the reporting CA, you do NOT have verification of a current business relationship between the reporting CA and the OC.

If the accounts are verified AND you receive NOTHING from the reporting CA, you send the reporting CA this:

Two quick questions just to be sure:


1. Since both of my collections are with the same collection agency, I can list both accounts within the same letter.... correct?


2. Also, where it says "This letter is being sent to you in response to your recent fraudulent verification of an unknown medical account on my (name of CRA) report" ... Can I put both Experian and Equifax on that line? Or do I need to send two separate letters for each CRA?

You can list both accounts in the same letter IF both accounts are showing on the report you are disputing.

 

You need to send separate letters for EACH CRA ( in the same envelope) because you will be sending a copy of THEIR lettyer to the CRA in the follow up dispute.

WhyChat, I have and update for you...

So I sent off the two letters as you advised, CMRR. They were set to be delivered last Friday (it's within the state here in NJ, so it didn't take long). Since both of the letters were going to the same place, I expected to get the green cards back at the same time. Somehow I think one of the cards got lost in the mail, because I only received one back in the mail, and it arrived on Monday. I figured I would give it an extra day or two and maybe it would show up.

Today I get home, and I already have two letters from the CA in response to what I sent last week. I have taken a picture of one of the letters (both letters are identical, with only the account information different), and have inserted them in this post. (Cropped out my info of course, lol.)

  • As you can see the PHI and HIPPA stuff that was contested, he totally throws out. He also cites a bunch of court cases as the reason.
  • Also, he states that the 30 day validation period has passed already. How is that if this is my first time contacting the CA. Sure, I disputed with the CRA, but does that count as the 30 day period with the CA since I never contacted them directly?

What would you advise would be the next steps? As I have said before, I know the amounts are legit, and I'm totally fine with paying them. I just want them off my reports.

Any help would be great, thanks!

This is validation that allows you to pay the 2 OCs with the HIPAA letter insert "a"

Hey WhyChat,

 

Just wanted to give you an update. After following your steps, one of the two collections got removed as of today :-) Very happy about this, so many many thanks to you for that.

 

But I'm at a standstill with the other collection (the $280 one). I followed the program exactly, and I sent the letter along with the payment to the original creditor. Only problem is, they haven't cashed it yet. I know they received it, because I got the green card back. I just don't know what to do now other than just wait.

 

Any advice? Due to the fact that I know they received the payment, is there another way I can get it taken off?

Give them a call, ask to speak to their security department, tell them that you have sent money to them that was signed for on x/xx/xxxx by xxxxx and that the money order may have been misappropriated as it has not yet been deposited.

Well it's an specialist group, that operates out of some hospitals for certain procedures (which was the case for me, I've never actually been to their office). This is the place to be exact --> http://advancedvascular.com

 

That's who the OC is being reported as, not the hospital. I will do what you said and wait 2 weeks them give them a call.

Hey Why Chat,

 

So I waited the 2 weeks then hit them up on the phone. Told the lady that the check wasn't deposited, told her who it was signed for delivery by and everything. She asked for my phone number and told me that she would look into it, and get back to me.

 

Yesterday, I receive a certified return receipt letter from them, with the check returned to me. The letter states:

 

"I have tried to reach you repeatedly by phone and have not been able to do so. We are returning your check for $280.00, the account has been in collection since December 12, 2011 and the matter is out of our hands at this point. You must contact Savit collections and remit payment to them. Their contact info is 732-XXX-XXXX and their mailing address is..."

 

That's it basically. So what am I to do now. Should I just go the route of paying this to the CA? Perhaps try to go a pay for delete route or something?

Pay Savit .

 

You could of course file a complaint against the OC for violation of your State laws on accepting cash payments, however, it is not worth it for that small an amount.AT THIS POINT

 

Make sure that when you pay Savit, you include a copy of all your correspondence to the OC and their response and state that you require a full deletion from your credit reports of the account.

 

Tell them that you will take appropriate action against ( OC ) for violations of the HIPAA privacy rules, the FCRA and FACTA for their refusal to accept a cash payment for medical services in violation of State and Federal regulations and for damage to your credit failing a complete deletion by Savit whose actions they are liable for under the laws of vicarious liability..

This company is extremely difficult and won't help remove anything on the credit report. I just called them as I was searching my credit reports. Hubby and I are getting our credit in order for a home in a year. Anyway..I called Sa-Vit to get them to send a letter to the 3 major credit bureaues and they told me they can't do that. I was speaking to a rep mind you. I was polite although she wasn't. She told me we cant help you, you need to wait 7 years for this to be off YOUR report! I spoke to a manager whom was just as rude as his rep. He told me the same thing. I asked him very nicely if there any way he can help me send this letter to the credit bureaus after he told me what the rep did. He said that there was an agreement with the FCB Fair Bredit Bureau soemthing to that effect where he wont help me or send the letter to the credit agencies.

 

Mind you before I spoke to the supervisor, I kindly asked the rude rep if she sould send me a copy that it was paid. She rudley told me well you have your credit report in front of you why do you need proof from us? I told her nicely that it would greatly appreciated to get a hard copy. She refused. I asked for an e-mail copy she refused then put me on hold. She came back to me and said that we can send another letter to you for 10.00 since you already recieved a copy of PAID collection account from us a few months back. I told her I never got it..I truly never did. She said well i guess you are going to pay the 10.00 then IF YOU REALLY WANT ANOTHER COPY! This agency is not helpful and rude.

 

So anyone who has this company and your account with them, be aware your collection activity with this company even paid, will be on your report for 7 years as they wont send any letter to the 3 major credit agencies. Just be prepared for this when you ask them to help you take off whatever collection activity especially paid with them. They get the money and DON"T REPORT IT TO THE BUREAUS!!! I understand not all company have to, but it would be nice. I've only had 3 accounts ever in collections and the colelction agencies were more than helpful help me. This Sa-Vit company won't really help you..they are too busy stating the rules after they harrass you for payment. Just be careful with this one.

 

I know my rights but i though I would post my expereince with them today on this forum. So if you are going to buy a home or anything with your credit report and you have this company, you better forget them sending a letter to the 3 major credit bureaus. Trust me they can send a letter to bureaus, they just dont want to.

Advice in this forum is VERY individual, just because you are dealing with the same Co. as this original poster is NO reason to believe that you should follow the same advice.

 

Start your own thread with data as to the dates of medical service and how it is reporting.
