I just received a civil summons today on a equity line of 47,000. First of all, It went to the WRONG address( my parents which I have not lived there in 25 years).

I am very upset that this happened...

My question is there any thing I can do since the address is not correct? I thnk they did this on purpose to harass me. My loan papers that are attached to the summons has the correct address on it!

 

I know that I have 30 days to respond, what happens if I don't!

I don't think that they would forclose because I am current on my First Mortgage and it is underwater by about $4,000.

Do they just issue a Judgement against the First?

 

I tried to go to this credit union and ask for a modification and they said that they do not do those on equity lines and could not help me.

Any suggestions?

You should file a response, file for meditation if your state offers it, and then work for a settlement of a percentage of the balance. If you are underwater they won't get much if they forclose.
