So, I had a bank account with USAA. I was preparing to file for Chapter 13, and zero'ed out the bank account because I had a loan with them, and I knew they would try to offset.

 

When I filed my Chapter 13 last summer, the account balance was ZERO.

 

As soon as they were notified of my Chapter 13, they charged my bank account a "Misc" fee of $10, which overdrew the account. They then hit with me overdraft fees and penalties and "wrote off" the account. Sent it to Chex (within 3 days of being served of my BK) with an overdraft balance of $110. All completely made up of bogus fees.

 

Should I fight this? Is it worth the trouble? Is there any hope?

Contact Chex with your BK filing number. They will remove or update the listed account to owing zero. This will allow you to obtain a bank account with issuers that run a chex report on you a LOT easier. You can do this for EWS as well.

 

 

There has got to be more to the Misc fee? Did you ever call to find out exactly what it was for?

did this happen during or after bk? they should not have been able to do that during and if your all done with bk just call chx and tell them it was included in your bk give them the file number and they will remove it!!

Chexsystems will remove you if you have filed a bankruptcy Chexsystems does have a department that deal with those that have filed a bankruptcy

You need to simply fax over the document you received when you filed (you don't have to wait for discharge papers). It shows the date of filing, the case number, the trustee and judge, etc The fax number is 602-659-2197
