Good evening Whychat I have started the hippa process as directed on your website.

 

It all started when I received a collections letter from a lawyers office. I checked my credit and they reported an account that is not paid from 2011. I also have another medical collections from another law office but that one was paid to avoid a judgement also from 2011. I sent your dv to the law office of the unpaid medical bill and they only sent me the original medical bill nothing else. Please note that the collection law office trying to collect is not noted on my credit report but another CA. At the same time I sent the 3 cra your sample dispute letters. Here are the responses.

 

Equifax verified both medical collections. One is paid one is not. (Note they verified a different CA not the law office that sent me the collections note.)

TransUnion Verified the paid medical collections and deleted the unpaid.

Experian Just sent a letter saying they think my letter was fraud and wanted me to dispute online.

 

So what are my next steps.

Send Ex. a short letter with proof of your identity, a copy of your drivers license a copy of your SS card and an original utility bill and a copy of THEIR letter. Request that they properly investigate your dispute of the unknown medical accounts (list them) and provide you with a written response as required under the FCRA and FACTA

 

Is the 2011 bill valid?? Do you have a matching bill from the OC or an EOMB from your insurance??

Why chat thanks for the response. I did opt out before sending the initial disputes. I did not delete the addresses because I am at the same address. I did move for a couple of months for a job but I am back at the address of original service.

 

Both collection offices have sent me a matching eob.

***Update***

 

Whychat thanks for your help. Experian and Transunion have removed both medical collection items. Equifax verified (AGAIN) even after I followed all your steps. Here are the details...

 

Equifax shows both accounts as verified

 

On my report I see collection agency (A) but they did not send me any response to your dispute letter. I actually got a letter from a law office. This office is not showing up on any of my credit reports. This law office is also sent me the initial letter that made me start this process. In response to your dispute letter to collection agency (A) this law office (I guess on behalf of this collection agency) only sent me a letter with a print out of a bill from the medical office and advised me to contact them if I am disputing the charges. They did not send me any signed contract and I am unsure if there is even a relationship.

 

Collection agency (B ) sent me a letter and contract from hospital and acknowledged the dispute.

 

What can I do now that Equifax verified but the other two CB's have removed the medical collection items.

Are you saying that you received a RECENT communication from CA "B" that was transmitted to them from the OC??

 

Is this the same account that is "stuck" on Eq.??

 

What is YOUR assessment as to the validity of their claim?? Do you have EOMBs or original bills??

 

When was the date of service??

 

This is from a Dr.'s office and NOT from a hospital??

Are you saying that you received a RECENT communication from CA "B" that was transmitted to them from the OC?? (No last communication was about 30 days ago after DV sent to dispute and to stop updating to credit bureaus.)

 

Is this the same account that is "stuck" on Eq.?? ​(Yes it is the same account stuck on EQ. I received a response from CA "B" that was transmitted to them from the OC after the step in your process where you state to send DV of dispute and to stop updating to credit bureaus. I made sure I sent off my response to CRA of no response as soon as I saw DV was received by CA. CA "A" did not even respond and I got a letter from a law office representing them. So CA "A" never responded to my DV. I guess the law office is now to be collecting for CA "A" but the law office is not showing on credit reports as new CA reporting debt)

(I believe CA "B" has a valid relationship with the OC. I do not believe CA "A" has a relationship. As I received a letter from the law office stating that they represent the CA "A" and I do not have a personal EOMB regarding the collection from CA "A". I can call my insurance carrier at the time and find out. )

 

When was the date of service?? (4/11)

 

This is from a Dr.'s office and NOT from a hospital?? (Yes this is from a Dr's office not a hospital. It was imaging. The letter from the law office representing CA "A" sent me a letter saying to contact Dr's office if am disputing bill. )

 

One more note CA "A" is unpaid and I have received a copy of a bill from a law office representing CA "A". They did not send me a signed contract or any details just a bill with details of service.This has been removed from EX and TU using your process. It is showing on EQ as unpaid.

 

CA "B" is showing with EQ as paid collections. I got a summons and went ahead and paid the CA as I wanted to avoid a judgment at all cost. It was removed from EX and TU after your process.

One more update the called my insurance provider and they stated the bill is valid and I do owe CA "A" so I can use the HIPAA letter insert "a" follow all the instructions and you will avoid getting a "paid" collection on your reports.

 

However I have NOT received a documented current relationship between the Health Care Provider and the reporting CA I only got a letter from a law office representing the CA.

Go ahead and pay the OC ( the "a" ) account using the HIPAA letter insert "a", make sure you pay the amount that your insurance says is owed as "patient responsibility" and include a copy of your EOMB if at all possible.

Check your credit reports ( back door) see if there is any change in the reporting of the account.

 

The follow up letters are posted on the HIPAA letter program after the last insert ("c")

Should I file a hippa complaint with the oc?

Since the account was deleted from TU and Ex and there is no clear "paper trail" of the OC having notified the CA of the payment, there is not enough evidence to file a HIPAA complaint against the OC.

 

It is logical to presume that your initial HIPAA letters to the OC and CA effectively deleted the account from Ex and TU, so that leaves Eq as the only culprit. Make sure when you file your complaint you check and see if the account on Eq is marked as "disputed by consumer" if it is not, you can add that violation to your complaint.

 

PLEASE check the back door of Eq before doing anything further, I would hate to think you were viewing an old report.

Wow after all this time when I filed a complaint then equifax removed it quick. Thanks for your help.
