Long story short, I've been rebuilding my credit for the last year or so, and have gotten it down to a few medical collections reporting on Experian and Equifax. I'm trying to get everything cleared off so I can apply for a home loan for my family. I think I may have messed up with the HIPPA process and am not sure how to proceed. I did a blanket dispute online in late January for all 3 bureaus, that was fairly effective as it got my report down to just the medicals and some student loans. After researching the WhyChat Hippa dispute method, I proceeded to follow those steps. I opted out and cleaned up former addresses. I then sent disputes to both Experian and Equifax as the method instructed. However I got back a reply today from Experian stating that they have already investigated this dispute and will not investigate again and that the information was verified by the creditor. I received this via mail. It referenced a report number, so checked the report online and it shows 4 of my collections on the dispute with 2 stating 'Remains' and 2 stating 'Pending'. I haven't received a response from Equifax yet.

So now I'm lost on what to do next, I'm hoping I didn't screw this up too bad by sending the letters in so close after a dispute. Would the letter stating that the account information is verified qualify for proof of relationship between the OC and CA? I haven't actually received any information stating the account number, balance, or anything else, just the status stating that the reported item remains.

Any advice on how to handle this would be greatly appreciated.

Yes, your new dispute got "merged" with your previous dispute.

However, it does not constitute a serious drawback.

Wait for your responses from the other CRAs on your medical disputes and then send the medical DV to the reporting CA(s)

You can put 2 or 3 letters in one envelope to each CA if their account has been verified by several CRAs

That way you can use the copy of the letter for each CRA and a copy of the ONE proof of receipt in the follow up dispute.

I am assuming you have followed all the initial steps:

Followup:

WhyChat, I followed initial steps. Accounts have been verified via CRA, no response from CAs and 30 day limit is up next week. Assuming I still don't get a response, I should proceed to the next step correct? My only point of confusion is when do I send the OC payment + HIPAA and when do I send the Medical DV to the CA. I have the following accounts:
3 Medicals with balances, I can pay, all OUTSIDE of Arkansas SOL for Medical
3 Medicals with 0 balances showing paid
3 Medicals with balances, I can pay all WITHIN Arkansas SOL for Medical

I think there is some miscommunication, I haven't sent medical DVs yet. At this point I have done the following:

1. Opted out

2. Remove old addresses

3.sent the initial HIPAA letter to the CRAs

I have received responses of the accounts being verified by the CRAs. I have received nothing from the CAs. So next step do I Medical DV the CAs for all accounts, those with balances and without, or just certain ones? And at what point does one pay the OC along with a HIPAA letter?

Here are my account types:

3 Medicals with balances, I can pay, all OUTSIDE of Arkansas SOL for Medical
3 Medicals with 0 balances showing paid
3 Medicals with balances, I can pay all WITHIN Arkansas SOL for Medical

Send the medical DVs to each CA reporting, paid or unpaid.

If it is reporting as unpaid you send this:

If it is reporting as paid you send this:

http://whychat.5u.com/ltrcavalhipaa.html#PAID

You then send the follow up letters

Understood, thanks for clarifying for me. The point of confusion was when it was required to engage the OC, I see though that it is only when the CA returns verification of the account. I will proceed as your guide states. Thanks again.

WhyChat,

I received verification from both credit bureaus, sent my Medical DVs to the CAs certified mail (No RR as they were Po boxes). Tracking shows the letters were delivered to the CAs today, so I sent the CRA disputes via CMRR.

However, this afternoon I received a letter addressed from one of the CAs that contains an itemized bill for one of the collections. The information is all there and intact and the itemization is on the OC's letterhead. Do I go ahead and pay the OC with insert A on this collection?

Recap: Received green cards from CRAs for follow up dispute. Sent payment and HIPPA letter with insert a to OC after I received confirmation of existing relationship from CA.

2nd CA sent me letters regarding two of the paid collections stating that they verified the accounts are paid and that they will request that the accounts being reported to the CRAs accurately reflect as being paid. How should I handle this? Should I wait until the CRAs finish their follow up disputes?

Wait and see if the follow up disputes get you a deletion. If not and if the account reporting changes to a "paid" collection you will have to use the follow up letters that are posted after insert "c" in the HIPAA letter program.

Experian verified again, not going to delete any of the paids. No further responses from CAs yet. Is Ex the only CRA who didn't delete the "paids"?? You sent the CA's the medical DV for accounts reporting as paid and sent Ex the follow up dispute-- and that was the one they responded to by verifying again?? Wait until you hear from the other CRAs on any pending accounts and post a recap of everything you have done

Exp and Eq are reporting different collections. Exp verified the followup dispute after I DV'd the CAs and verified the paids. I'm still waiting on EQ so I'll give you the full synopsis after it gets in.
