My husbands home*(before he met me) went into foreclosure in 2009. It is reported on his credit report as"foreclosure, collateral sold". Last updated Oct 2009. Now in 2010 we get a call from an attorney firm stating that our forclosure has been exspunged?? and we own the home again? The office is saying they couldnt find the original paperwork(BOA). So then it went through the forclosure process again... We have been renting this whole time to let time heal some of the credit problems but we got a call again and we have the home again... and they want to start the process all over. I need to know what are my rights with this... its been 4 yrs and now cant qualify for a home and have house that keeps falling back into our laps. Any ideas how i can fight this. Or can i report to CR that its not a foreclosure?? not sure how to proceed?

This may not be the answer that you want to read, but hire an attorney. This issue has been popping up all over the USA. Seek legal advice from an attorney. The cost can be considerably less expensive than most people think. Which state are you in?

 

I had a friend in a similar situation and he was able to postpone the foreclosure for 2 additional years. He also rented the place out and was able to save a nice wad of cash.

In Michigan. we dont want the house but want to move on after the last 4 yrs of renting we are ready to buy. But no one will will let us with CR opeining it up and forclosing every other year. I was just thinking if they are stating on TU that its been forclosed and collateral sold that i may be able to dispute it due to misinformation that they are saying we own it. No Realtor will touch it due to so many issues with the property deed. It was 14 acres and a mile long driveway that forked off to another property and they bought the land and the driveway and so even if you bought the house you cant get to it??!! its a mess. BOA is offering 50,000 for the house when the note was 345,000 just to get rid of it. It is just way out in the sticks and we have kids now.

Oh, I understand.

 

I would advise speaking with a consumer protection attorney. They are well versed on how to proceed and most charge a nominal fee. Keep us updated.
