Hey gang, apologies if this is posted in the wrong sub-forum:

 

In a nutshell: Being sued over a credit card debt. Hired a lawyer and he was supposed to attend a court hearing. Got a letter from the Court that the Plaintiff showed, but the Defendant did not, so judgement for liability awarded in Plaintiff's benefit.

 

The lawyer has yet to return my call or e-mail me back....

 

So what are my next steps with regards to both the Court and a lawyer who is MIA?

1) go to court and explain your kawyer was supposed to show. Have Judgement vacated

2) Read everything related to going to court here. Pinned topic in help, I've been served

3) Admit to nothing! You want the plaintiff to show that you owe thus debt and the amount they claim. I had a creditor unable to produce this. It was withdrawn after going to court 3x with prejudice. They could NOT sue me again.

Best of luck, I believe you can be the best advocate for yourself.

4) If you actually retained the lawyer to represent you and he didn't show up, file a grievance with the attorney licensing and regulation authority in your state. Google it to see what entity does it in your state. Include the fact that he won't return calls.

Thanks for the replies.

 

Yes, the Lawyer was paid and we signed his contract that states he would go to Court on my behalf. I got in touch with the appropriate office to file a grievance and will be working with them.

 

I'll contact the Court and talk to the clerk about what's going on.
