So my power of attorney started (POA) getting call on a 3 year old apartment rent debt (in-service at the time) where my roomates ditched the apartment early. Then the POA got a letter saying he had 30 days to dispute or it was going on my credit report.

 

The POA sent a dispute letter certified mail within the 30 days.

 

We never heard anything back.

 

Now I am back home and find out that the Collections Agency went ahead and filed the report on my Credit Report anyway, with the comment

"Account information disputed by consumer (Meets requirement of the Fair Credit Reporting Act)."

 

As I understand the FCRA this was illegal and that if I dispute something in writing in the 30 day window that they are REQUIRED to send me a response validating the debit before they can put anything on my credit report.

 

Do I understand this right???? Now what do I do???

We all like to use that one, but you may get better luck with the Active duty / SCRA in addition to the FDCPA.

 

what was the deal with the Apt - did you or they get PCS orders?

Write the CA and specifically state that you were actively deployed on the date your POA was first contacted, and that verfication of the debt and the legal basis for this was requested, but never recieved.

 

and that you have recently returned, pulled your credit report and noticed that the following account was listed; yada, yada - copy in exactly as listed on your report.

 

It was your understanding that credit reporting is considered collection activity pursuant to the FDCPA, and since this account was never validated, why are they reporting, since the FDCPA doesn't allow it.

 

YOur firm is in violation of the FDCPA and FCRA - and even though you've been reporting since ss-ss-ssss, Decmeber xx- 2012 is the date I discovered this violation.

 

Delete this reporting or face the legal consequences.
