Need advice on helping a relative get groceries & get gas reimbursed.

Need advice on helping a relative get groceries & get gas reimbursed. POA is questioning me. I get groceries for my relative, she writes a check in my name. I go to her bank & cash it. Use the money to buy groceries, give her the change back, she reimburses me with gas money. However, the Power of Attorney doesn’t want to do his job fully. Just partially. She does need help with finances. The POA is going to be looking at her checks & transaction each week. Is there any better way of getting her groceries & getting gas reimbursement? I don’t want to become a joint account holder. I don’t want to become a conservator or fight the POA.

 

 

The POA also thinks the check written to "Cash" was given to me. That is not true.

I don't completely understand the situation - more info is needed, but POACH doesn't take away the persons rights. It's not the POAs job to quests what the person does with their money.

Well ... I didn't have anyone looking over my shoulder like you when I was doing the same for a relative of mine.

 

What about if the relative simply let you take his/her debit card rather than cash? Then the groceries show up on the bank statement as from "XYZ Food Store". But quite simply, it would be better if the relative told the PoA to mind their own business. The PoA is not a conservator or guardian.

 

What is it that the PoA doesn't want to do? This is being made way more difficult than it should be. Bordering nonsense.

She doesn’t have a debit card, isn’t that illegal to use it even with permission? I read that somewhere.


Sorry I am late replying. Not getting notifications. I may have to tell her, make me power of attorney on her checking or I won’t be getting groceries or we will have to end up going to attorney to force to POA to do his job. This would the make the POA mad at us.

Illegal, no. A merchant can refuse to accept it however. Seriously though, how many merchants actually look at the name on the card these days - especially in a grocery store?

I still don't get what the issue with the PoA is ... could you make it more clear?

 

You could have her either add you to her bank account as a signer on the account or have a PoA drawn up to allow you to sign checks on her account. In either case, you will NOT be a joint account holder and will not have any rights other than to sign checks on the account.
