I have a collection account on my TU and EQ report that is showing unpaid for $147 from 10/2007. I have completed the Opt-out and successfully removed all old addresses from both TU & EQ. I am ready to send the Pre HIPAA Medical Dispute Letter to CRA but today realized that this is also showing up on my husbands CR but with different data being reported.

 

Here are the differences:

 

My EQ report:

 

Date Reported: 10/2007

Date Assigned: 08/2007

Creditor Classification: Medical/Health Care

Creditor Name:

Accounts Number: 93XXXX

Account Owner: Individual Account.

Original Amount Owned: $147

Date of 1 st Delinquency: 01/2007

Balance Date: 10/2007

Balance Owned: $147

Last Payment Date : N/A

Status Date: 10/2007

Status: D - Unpaid

Comments: Medical

 

Husband's EQ report:

 

 

Date Reported: 10/2007

Date Assigned: 09/2007

Creditor Classification: Medical/Health Care

Creditor Name:

Accounts Number: 93XXXX

Account Owner: Individual Account.

Original Amount Owned: $153

Date of 1 st Delinquency: 03/2007

Balance Date: 10/2007

Balance Owned: $153

Last Payment Date : N/A

Status Date: 10/2007

Status: D - Unpaid

Comments: Medical

 

They both show "Individual Account" but with different Amounts owed, Date Assigned and 1st Deliquency dates. My question is now that I am ready to send the HIPAA letter for myself, should I postpone sending it until I start the Opt-out and removing old addresses from my husband's CR first or will it matter? And can I use this type of discrepancy as leverage for not being a "valid" account?

I went ahead and moved forward with the HIPAA process for myself. I still would like to know how discrepancies showing on mine & my husbands CR are handled? But I do have another question with this process.

 

Here are the steps I have followed so far.

 

1. Opt-Out- complete

 

2. Deleted old address - complete

 

3. Sent initial dispute to CRA via CM w/o RR.- complete

TU- Deleted medical collection

EQ- Results are: We have verified this item belongs to you. If you have additional questions about this item please contact CA. I also verified via backdoor method with EQ that this collection still shows consumer disputes.

 

4. Sent Medical DV Letter to CA via CMRR - complete

Received green card in mail yesterday.

 

I am now ready to send the Follow Up Letter to CRA via CMRR with attached photocopies of letter and green card. My question is on the follow up letter, it states "I have disputed this unknown medical account with the reportingCollection Agent,( copy enclosed with proof of their receipt),as per yourinstructions in your response of xx/xx/xxxx to my dispute of xx/xx/xxxx andhave had no valid response." but technically, I haven't given the CA 30 days to respond. The instructions say as soon as I receive the green card to send the follow up, but shouldn't I have to wait the 30 days before sending it? Please explain.

There is nothing in the medical DV giving the reporting CA 30 days to respond.

They HAD the opportunity to validate when they received the investigation request from the CRA when you sent the initial dispute letter. IF they had the account data they would have immediately responded to you with that information THEN.

"I require compliance with the terms and conditions of this letter within 30 days. or a complete withdrawal, in writing, of any claim."

 

But I understand your point that the CA had time from the day my initial dispute was reported.

 

One more question, what is the address to send this dispute to EQ. I know they use CSC Credit Services ( PO BOX 619054, Dallas TX 75261-9054) and that is where I sent my initial dispute. But I've seen several other address in this forum for Equifax. I want to make sure I have the correct address.
