I used your HIPAA process on my reports to clean it up. The only medical I actually paid was to an OC hospital. It was with a CA who quit reporting at some point in my dispute/medical DV process. I paid the OC because I knew we owed it (it was for my wife) and because I thought I had a window where the OC had the account back and I wanted to pay it before it wound up with someone else.

 

Now we decided to look at my wife's reports and bingo, there it is along with three other bills from the same time. It now shows as paid. All four accounts are with the same CA. This same CA had 6 accounts with me, only this one that stuck after I disputed with the pre HIPAA letter.

 

My question is does the pre HIPAA letter say anything different with this account since it is paid? I am thinking not. Old addresses removed - SSNs cleaned up, opted out, etc already done.

Did you pay the OC with the HIPAA letter insert "a"??

If not, then send the initial dispute letter to the CRAs

I did pay the OC with insert A and it is not on my report. I only referenced my reports because at the time I didn't know it was on my wife's.

 

That's the problem. I haven't done anything with it yet there. I am thinking I need to send the CRA the initial dispute right?

Not neccessarily-- if you used insert "a" and referenced the CA in the letter-

Your furnishing of my account information to (collection agency name), is not in compliance with HIPAA,or (name of your State}'s Privacy Act, and any subsequent reporting of this account on my credit reports to (credit reporting bureaus) is a clear violation of Public Law 104-191 ("HIPAA") since there can be no permissible business purpose in divulging protected health information to anyone on an account once there is no longer any payment due.

 

You can go to the follow up dispute because the letter to the CRA in the follow up dispute says:

Please re-investigate (or investigate if you have not previously disputed) the following disputed account on my credit report.

 

The fact that you wrote the letter in YOUR name and the account was changed to a "paid" collection on your WIFE's report is unimportant as long it is the same account and the same CA.
