Hey Guys and Gals..

Sorry Mods, I didn't even know there was a medical bill section please delete old thread in credit forum.

Okay back to my situation. I filed for bankruptcy 03/30/12. My creditors meeting is 4/27. I`ll be discharged 2-3 months after that. On my CR I have about 15 separate accounts from the same CA. I called the hospital to inform them that I have filed bankruptcy and when I am discharged if they can pull the debt back from the CA and have them delete the accounts from my CR. They said No. Once it's a bad debt they will not work with me etc. I asked this because the CA that holds my accounts are just assigned the accounts and they are not sold off.

As I was going through the boards, someone said if the CA sets a term on the accounts on the CR this is a violation. Which all accounts have a Term set for 1 month on the accounts but they have closed all accounts but the term still remains 1 month. I know when I am discharged they will changed the balances to 0. But if this is a true violation how can I get them all deleted? I need steps since the OC won't work with me and the CA will not work with me. I make minimum wage and I cannot afford 6k in medical bills.

I don't mean to be difficult but I am searching for a helping hand.

You are filing Ch 13??

If the CAs do not appear at the hearing, their claim is wiped out. If these are medical accounts it is almost impossible for them to appear as they would be in violation of the HIPAA privacy rules.

If you are filing Ch7 they will be wiped out anyway.

At some point you will need to clean your reports of all of these.

You can start now by opting out

You can then send this letter to each CRA ( use a REAL report To order, visit annualcreditreport.com,or call 1-877-322-8228)

You should wait until you have cleared as many old addresses off your reports as possible before sending this dispute letter

To get old addresses deleted, send a brief handwritten letter to each CRA stating that the following address(es) are invalid and you need to have them deleted as you are concerned about ID theft/fraud. Provide proof of your current address, a copy of your drivers license, a copy of your SScard, and an ORIGINAL recent utility bill. Make SURE you have opted out FIRST. If you have any CLOSED GOOD OLD ACCOUNTS, call or write them and ask them to update your address.

Should I wait until I am discharged? and I filed a Chapter 7. If I send these hipaa disputes to the CRA will they delete the bills?

Well I opted out I`m gonna start writing the letters for removing old addresses. What if my Driver license has my old address? Do I update my new address with them?

You opt out to prevent your data being sold to data miners who will POISON your reports down the line with all sorts of accounts you may have had in the past, or accounts of people with a similar name. It will be a long time before you will qualify for any decent credit card offers and if you want to start rebuilding your credit you are better off looking in the BK forum for "re-builder" cards. You need to update your drivers license before you do anything else, otherwise you will not be able to clean your reports.

Also, I was able to get quite a few addresses deleted from experian but, again they will not delete certain address's because they are tied to those medical collections.

Once you have been able to get old addresses off as much as possible you will THEN start sending out to the CRAs the initial dispute letters:

Go to the post office and get a dozen certified mail forms, you can also pick up a FEW return receipt cards. This way you will have the certified mail # to insert into each letter.
You do NOT want to send mail that requires a signature at the Post Office for the initial dispute to the CRAs as THOSE letters are sent to a different department for handling as they are classified by the CRAs as "non-consumer" correspondence and are not accorded the same treatment under FACTA as consumer disputes. They are treated as communications from lawyers or CROs ( Credit Repair Organizations)

Communicating directly in any way for any reason with any CA at this point is counterproductive. You have opted out so they will not have "notice" of your new address. Once you send your initial dispute to the CRAs if they are unable to automatically have their computer verification system ( e-oscar) verify your account because they have only your old address, the account will be deleted.

On accounts that are NOT deleted and that do NOT show IIB after your discharge, you can get them deleted by THEN sending follow up medical DVs and follow up disputes which I will help you with when you get to that point.

Well, Experian and Equifax put fraud alerts on my Creditreports because there were address I have never seen on my CR. Will this affect anything? Also can you help me try to convince the CRA's to delete all my old addresses and update it with my current one that will be on my new ID?

Over the phone the CRA's said they cannot delete two of the addresses because they were being reported by creditors (The collection agency). What route should I take because if they don't delete the old addresses of course they wont delete the tradelines. The collections are only on TU and EXP. There are about 10 of them on each report. If the CRA's delete can they just appear on my CR again?

Okay, I will wait for my new ID to send the CRA's my id, my ssn and a utility bill. Then I will send out the letter. I will pm you a copy of the letter before I send to make sure it is all good. Is that okay?

I wish you hadn't called them. Your calls or on line disputes are entered into the system and MAY interfere with your written disputes of your addresses.

I don't know what will occur once you properly dispute the addresses with each CRA, however, I strongly urge you to stop calling, e-mailing, faxing or sending out smoke signals or carrier pigeons to either the CRAs or the CAs or the OCs.

Your reporting creditors have already been notified by the BK Court of your current address. Wait until after your discharge and send each CRA the initial dispute letter.

Make sure you HAND ADDRESS the envelope, use personalized stationery and purple or teal font, ( preferably italic this is helps prevent the automated scanning/reading/response computer programs from "reading" your letter as they can not read handwriting or distinguish font in the same color family as a background pattern).

DO NOT send it RR -WAIT FOR THE FULL RESPONSE FROM THE CRA BEFORE CONTINUING WITH THE HIPAA LETTER PROCESS

As long as it is more than 90 days since you last had any response from a dispute to the CRAs, and as long as you follow all the instructions:

I pulled my TU report randomly and all of the medical collections have been removed.. I did not dispute or anything or send out any letters. I pull up experian and I still have all of them. Experian will not delete the old addresses! Because, they say they pertain to those accounts and my BK. I decided to wait for discharge which is on the 26th of this month. But then should I send the letter you told me to send to experian? Even if the addresses are still listed on my CR?

I just want these off, but I want to go about it correctly to the TEE.

Yes, you should have no problem getting them off your Ex report, they probably came off your TU report as soon as the BK data hit.
