Hello CB'ers and Military Members :)

 

Figured this forum section would be the place to start.

 

I've already read all the newbie's breifings and have done searches nonstop. I feel that I know that I'm screwed.

 

In 2006 I finished my enlistment with the AF. I had a new Subaru, got a nice apartment, and had no worries of my future knowing that with my qualifications of "heavy gunner" and "fence security" were going to get me far........

I quickly voluntarily gave back the Subaru to Chase, left my apartment, and lived off a couple credit cards until I got a military contract making nothing.

 

I know have:

 

Chage Offs - All 2007

Chase (Subaru) - Charge off $9700

BAO CC - Charge off $2851

Chase CC - Charge off $2275 - I don't believe this is mine - I'm the III'd and I believe this is my dads as he banks through chase

HSBC Best Buy - Charge off - gives no amount

 

Collections: Everything Date of first Delinquency in 2007 and I haven't paid a dime since

Asset Acceptance CC- $4631

Midland phone contract - $474

Midland CC - $3283

 

and a few others less than 1k that i pif (not knowing about this board and all the information i know now) just a couple weeks ago.

 

 

This is where I'm stuck. I just filed my SF86 reinvestigation and know that I am screwed unless I do something on my collection accounts.

I have been offered PIF settlements for all 3 collections and can afford to pay all 3 settlements but I know that this will do absolutely nothing to help out my credit. I've read Midland is the worst too! The two CC's are from Colorado and I believe that the SOL is 3 years which should give me a little leverage. I am unsure of the phone contract but would just pay that off in full if needed.

 

I think I have a month before the Investigator calls me so I don't think I have time to sit around and send out DV letters. I need to get things done asap. I am also living overseas working for the Army as a contractor so that puts me at a slight disadvantage.

 

If I don't get this fixed I'll most likely get laid off and my plan on enlisting in the Army when I return in Sept will most likely not happen.

 

Any help would be greatly appreciated.

Depending on what state you lived in, your old debts are probably past the SOL (Statute of Limitations). My plan of action would be simple:

Negotiate PFD's (Pay For Deletion's) IN WRITING for each one. Be sure to offer the PFD's WITHOUT admitting you owe the debt, otherwise it can reset the SOL clock.

 

Search this board for sample letters and more info on writing a PFD.

 

Since you have the financial means for this and debts are most likely past SOL, you should have a very good shot to get everything deleted from your credit reports.

You should be ok as long as you do not lie on the SF 86. Make a plan and start on it. do not lie that is the big thing.,

Like previously mentioned, tell the truth. But in regards to the debt, they (OPM) want to see that you have a plan to pay your debt and that you are taking action on that plan. It's best to start now, so that it doesn't look like you are only doing this just to get the clearence.

 

What might happen is they grant you the clearance and then check up on it 6 months from now. So ensure you stick to your plan.

 

As Plat stated, PFD's is the best route to go if you can get them. Just becareful on how you word it.

To echo what everyone has said here;

 

 

Sit down and get a plan together now. The investigator is only going to be concerned with thing under 3 years old. I hate to say this but it’s best to show positive payment, but I think the PFD letters might do just fine.

 

 

Make a folder for each account. In the folder have a Primary and Alternate Plan for paying back the debt.

I know someone that received a secret but the clearance was reviewed in 5 years and no progress had been made on the debt. So they told She/he they had a certain amount of time to pay down their debt or they would revoke their clearance. (The clearance was revoked because the person was not working at the time)

Ok folks let me tell you from personal experience: Depending on what state you lived in, your old debts are probably past the SOL (Statute of Limitations). This does not apply to the WHS/DOHA adjunication process!!!! Even if that debt is gone and not showing on your report; it does not mean that you will be adjunicated by DOD/WHS!!!!! For example: I did not know that I had a bad check for $10.00 (pizza hut) from 2003! It was not on my current reports as a matter of fact it fell off in 2005 report! I still had to prove to the judge that it was taken care of which only cost me $25.00; the funny thing is that I still have the same bank account to date!!!!

My husband has a top secret clearance. He was told that filing BK looks better than letting things sit and slide. He was told a BK shows an effort to clean up the mess, otherwise, they feel the person is ignoring everything - does not care.

Not necessarily true. I mean, it's all relative. I have seen numerous instances in my units where they look at the fundamental reasons for filing BK. If you are really economically unable to clean up the mess, than BK might not look too bad. If, however, you were able to clean up the mess but went the easy route you may find it difficult to get clearance renewed.
