Actually I did read all my letters on this website as they took the case over. I spoke to someone there today and they said my complaint was still in review, being investigated. I complained how I am now on my 4th SPOC and they still refuse to return my calls. I complained that according to the HAMP regulations they are required by law to provide each case with a SPOC that will return calls and be the number one contact. Which they have failed to do. PNC already had a lawsuit against them for not complying with these regulations last April (which I brought back up) I am also sending my docs both by faxes and also certified mail. I am also recording all the conversations I have with the reps, after I inform them of coarse. Covering all my basis. I would love it if we could compare our stories to help this fight. PM me if you want to do that. Maybe we can get others to join in and complain to the OCC or CFPB to make them liable for the way they are conducting their business illegally with misinformation and lies, basically blowing us off until they can close out our files.

We have been receiving hang up calls from PNC the last week. We spoke to someone today after calling back the phone number that we were getting hang up calls, and believe it or not, they asked us to fill out another packet!!!! We asked them why they want us to continue to fill out packets if it will result in the same answer? They don't have a reason. Then we asked about reinstatement, and they said to contact the lawyer office, but we have left phone messages and email messages and have not received a reinstatement amount yet. They told us there was no way to get around the lawyer fees. Then we asked why we haven't received a phone call from the "supervisor" and they said they didn't know why, but they would send her another email. Then, they said they would also send an email to the guy who said they would start a review process and talk to a supervisor. So, really, back to square one. I don't know who else to contact or what to do....haven't heard from the CFPB though....so I don't know if that is good news or bad.

Anyways, that's my update. Nothing really - same place that we were almost a year ago. In limbo!

Well you may want to invest on a phone recorder, we've had one for a few years now. Our lawyer advised us to respond this way when they say those magic words "please be advised that this phone call may be recorded for quality and training purposes" I am then to say "Yes I am aware that this phone call is being recorded" That covers my end too he said. I have them now on tape saying they have everything they need, then blatantly not reviewing the documents before calling me three times a week asking for the same things over and over again that I have already sent in. I also have them on tape saying they don't need this "document" that they spoke to the negotiator and that person's name, Then the next day someone else tells me they need it. I was also advised by my lawyer to send my documents both via fax and certified mail. I am waiting for my husband's letter of employment to send and then I am sending that last package with the fax confirmation sheet certified mail.

If PNC has hired an attorney (like in my case) the CFPB cannot help you anymore. They informed me that it's out of their hands now. So I am taking this on myself. If it comes down to it, I may hire an attorney to get involved, but right now my attorneys are just giving me free advice. So I will continue to do as they advise. Keep me up to date. take care, J

Well still in limbo mode here. I was told by yet another rep that I didn't need a P&L now that my husband is working for someone else and not ourselves. Yet he is still considered self employed because he will be 1099'd at the end of the year. They have now requested once again the 4506T form as the last one is now over 90 days. They also requested his last two paycheck stubs for May & June. Still no sale date, I'm still recording each conversation I have with them so if if comes to that I can prove that they strung me along. I will go to court and fight this if I can. It's all bull. Oh and the OCC and the Government website where I filed my complaint now says I can't get their help now that they hired an attorney. My complaint was filed way prior to that. This is just not right!

Well still in limbo mode here. I was told by yet another rep that I didn't need a P&L now that my husband is working for someone else and not ourselves. Yet he is still considered self employed because he will be 1099'd at the end of the year. They have now requested once again the 4506T form as the last one is now over 90 days. Oh and the OCC and the Government website where I filed my complaint now says I can't get their help now that they hired an attorney. My complaint was filed way prior to that. This is just not right!



We're still caught in the paperwork merry-go-round too. They finally sent us a reinstatement letter from the "lawyer" and out of $15,000+, about $5,000 are in fees that might or might not be accurate. You may or may not get a refund depending on actual costs, and you could potentially have additional fees tacked on if the estimate is too low for the legal costs! Uh, no, I'd rather take my chance with the foreclosure than to have these amounts hanging over our heads!

They send someone once a month to take pictures and see if we are still living in the house. We also had to recently send another 4506T, and pay stubs. No sale date here either. We just keep going back and forth on the paperwork. So, still stuck in limbo. I've never heard another word from the OCC complaint I made.

I doubt it will work, but dh and I are going to talk to a small town bank near us and see if they would consider refinancing our house. I doubt we will have any luck, but we have to try.

Just wanted to give you an update. I read on another forum that there are people like us who are still living in their house four and five years later - still in limbo, still sending in paperwork. I hope that they resolve all of this before the winter.

Well the deadline for the HAMP ends this Christmas, so they better get their asses in gear! Same here they are requesting new docs again, it's so tiring..:( over and over.. things they already have, things that have expired because they wait so long..yadda, yadda... It's pure BS!


I guess because we filed bk7 they can't go after us, Thank GOD:) yet time after time each phone call is different. Each rep has no clue and tells me "this is an attempt to collect a debt" I have to stop them and say "read the notes, I am in BK7 and this is NOT an attempt to collect a debt" Then they say, Oh I see you have been discharged and you are no longer liable for the debt but we are securing our collateral in the property... Blah blah blah... I have it all recorded, maybe I need to turn this into my attorney for violation of the auto stay as we have not been discharged yet. PNC thinks we have, we actually were for about two hours, but we had a pending violation of someone violating our auto stay by a lawsuit and my lawyer gave them a chance, they kept the case open so he let go and fired on them and won. He is now awarded attorney fees, I don't know if we will see anything, but it made him something. I'm good with that, he has helped us well over and above what we paid him.
About those fees with PNC, I think they are adding all our late payments and interest to the grand total, instead of just the principle. Call and ask, that's what I see. We have seen people coming by too taking photos, it's sickening, my kids out playing in the yard and those blood sucking vultures are out there waiting for their chance to take it. It makes me so sick, Although this house needs allot of work, it's not just a house it's our home. We built this house ourselves 15 years ago, stuffed the walls with the best insulation. Stained the tongue and groove ceilings. Designed the closet spaces. Then later did a hardscape package (that was our line of work) Our house needs much work, paint, stain, new floors, new alot of things, but right now, we are happy to just have it. We hope we can keep it and do those much needed things later.
We have no options for refinance due to the Bk and multiple FC's due to our business, so we are basically Fk'd. Excuse the language abbreviations:)

Oh and about that OCC complaint, I did get a response, but it said because our file was already turned over to the lawyers (on their end) their hands were tied. Bull Shit in my book. Noone is there to help us, and we asked for it early on! This is just NOT RIGHT!!! I am ready to FIGHT! They will NOT take my home from me! I will fight for it! They made me default by telling me about the loan mod requirements and then would not take a payment. They MADE ME get so far behind in my payments, I can never catch them up. Did PNC file a Motion for Relief from the Automatic Stay? And if so was it granted? If so they can pursue foreclosure while you are in BK once the stay has been lifted for them.

The rest sounds like a mess and I am sorry this is all still in Limbo. I can't imagine the stress.

Yes and they got it lifted back in April, there is still no foreclosure date, but they continue to ask for paperwork. The same papers I have sent in multiple times. They just say if it's over 90 days I need to send it again. IE. my tax return, extension, Pay stubs...etc...I am beside myself and so want to just get this loan mod approved.
I don't know what will happen. :(

We have to try something....even if we just refinance. The specialist says we might have a chance, and we will know more in a week or two. That's funny because I can't count how many of those we have sent back to them and never had a problem. This one was filled out the same. My hubby's pay is messed up right now due to him being on short term disability for a surgery, so they might consider us for HAMP this time, but I doubt it. If you google PNC and HAMP problems, you will find other forums with people who are experiencing the same problems. I forget the last one I checked out which was a consumer complaint board and one guy has been doing the paperwork thing for three or four years! He said they had tried to foreclose a couple of times, but couldn't due to a paperwork issue, so they just keep sending him HAMP and he fills it out, gets denied, and then they start over again. So, we are definitely not the only ones going through this, but many of them were hesitant to start a lawsuit because it mostly has to do with people who were discharging the mortgage in bankruptcy, in which case, it's within their legal rights to file the foreclosure, but my concern now is that there is something wrong with the paperwork end of things....so we have someone looking at all of ours. It's so upsetting to be in limbo....never knowing what is going to happen. :( Hang in there!

New development. Apparently they did not get our response we filed back in January with the courts in response to their foreclosure claim. They have filed new paperwork to be heard on July 9th where they want the judge to sign the property over to them for sale immediately! Ugh. Funny because we are still in the HAMP process with PNC right now. Turns out that once they find out that we filed a response, it stops this motion, but we suspect from the paperwork that this is possibly an illegal foreclosure - there is some strange paperwork and we are being advised by several people to get a lawyer! Ugh.

We have a very important doctor's appointment for our son that day, so I have to send a letter to the court and the "law firm" letting them know that we can't be there. I have no idea what is going to happen next, but I'm not going down without a fight!!!!!!

That's crazy, they can't just throw you out without proper notice and proper paperwork? Also being you are still in review for HAMP, it would be illegal to actually sell the property while under review. I would definitely get an attorney involved asap. one of you should go tp the hearing and state that you have requested an independent mortgage reveiw thru the Fed reserve program. ( which you really need to do....!!! )

Agencies Release Financial Remediation Guidance, Extend Deadline for Requesting a Free Independent Foreclosure Review to September 30, 2012

The Office of the Comptroller of the Currency and the Federal Reserve Board Thursday released guidance that will be used in determining the compensation or other remedy that borrowers will receive for financial injury identified during the Independent Foreclosure Review. The agencies also announced the extension of the deadline for eligible borrowers to request a free review of their mortgage foreclosures under the Independent Foreclosure Review to September 30, 2012. The new deadline gives borrowers two additional months to submit a request for review.

The guidance helps ensure that similarly situated borrowers who suffered financial injury as a result of errors in foreclosure actions on their homes are treated similarly. Under the guidance, remediation for injuries may include lump-sum payments, suspension or rescission of a foreclosure, a loan modification or other loss mitigation assistance, correction of credit reports, or correction of deficiency amounts and records. Lump sum payments can range from $500 to, in the most egregious cases, $125,000 plus equity.

The guidance covers many examples, but does not cover all possible scenarios. Examples of some of the actions by a servicer that might have resulted in financial injury include:

  • Foreclosing on a borrower in violation of the Servicemembers Civil Relief Act;
  • Foreclosing on a borrower who was not in default on the mortgage;
  • Failing to convert a qualified borrower to a permanent modification after successful completion of a written modified payment plan that was supposed to lead to permanent modification;
  • Foreclosing on a borrower prior to expiration of a written modified payment plan that leads to permanent modification, while borrower was performing all requirements of the written plan;
  • Denying a borrower's loan modification application that should have been approved;
  • Failing to offer loan modification options as required by an applicable program;
  • Giving a borrower a loan modification with a higher interest rate than should have been charged under the relevant loan modification program;
  • Foreclosing on a borrower in violation of federal bankruptcy laws;
  • Not providing a borrower with proper notification during the foreclosure process; and
  • Committing errors that did not result in foreclosure, but resulted in other financial injury.
Requesting a review does not preclude borrowers from taking other actions related to their foreclosures. A servicer is not permitted to require a borrower to sign a waiver of the borrower's ability to pursue claims against the servicer in order to receive compensation under the Independent Foreclosure Review.

The announcements continue efforts to implement actions that the agencies required of servicers in enforcement actions issued in April 2011 to correct unsafe and unsound mortgage servicing and foreclosure practices. Those orders required servicers to retain independent consultants to review foreclosures that were in process in 2009 or 2010, and required servicers to remediate financial injury that is found.

Unfortunately, my loan does not qualify for that review program because it says this: To be eligible, your mortgage must have been active in the foreclosure process between January 1, 2009, and December 31, 2010. My foreclosure officially started in December 2011.
