I am talking about my cousin again.

 

He gets SSI and his mother his the Social Security payee.

She doesn't trust "Social Security"

 

She is getting old. The only person she really trust to handle things in her family is her son including medical decisions. The state doesn't considered him disabled. State has even stronger guidelines.

 

 

Since she can't afford an attorney. They are going to give each other power of attorney. They might add something despite his disability. The power of attorney would be effected immediately and wouldn't be revoked if the person become mental or physically disabled. They are going to type the power of attorney forms up herself and have them notarized. The state they live in is Indiana.

 

From what I understand, you can type up anything & as long as it is notarized it is legal.

A person can designate anyone they choose to be their power of attorney. If the person they want is him/herself mentally disabled, hospitals are generally allowed to ignore the POA document if they believe the metal disability makes the person unable to make decision. That is rare, though.

 

If it's a physical disability, unless it prevents the POA person from expressing his or her decisions, go for it.
