I have 3 lines on my credit report from MRS BPO stating 27,XXX - 26,XXX and 10, XXX.

 

I have been told this is for student loans, but i cant tell since the credit report doesn't state what type of debt it is.

 

I went to a community college, so i never took out that much debt

 

1) my father appears to be the consigner, but I believe he may have used my information after the 10k loan in order to take out more loans in my name, which he blew through them

 

2) they're wrong about the information and tied my name into someone else

 

I can provide a screen shot of the experian report if needed

 

 

I know if I am a victim of ID theft, I can file a police report. The issue is, I did have the one 10k loan, but the other larger amounts were not for me. My dad passed away 5 years ago , so I am not able to confront him about it. I know it will look suspicious also.

 

I want to know if there is any legit chance of getting these discharged in BK.

 

Right now, after all my current garnishments/judgements/child support, I am barely living and often spend weeks at a time homeless to ensure all my bills are paid. I have been climbing an uphill battle, but have reduced my debt significantly over the past several months.

 

They have never contacted me once on my default status, stopped paying on them in 2007. I live in PA.

If these are Parent PLUS loans and your father has passed, they would be forgiven upon his death or the death of the student. BUT, they must be the parent who signed for them. You cannot file BK on them. All the Dept of Ed would need is his death certificate.

 

It sounds like a LOT of $ for community college.

exactly, I never needed that much nor did I take out that much.

 

I utilized a pell grant and stafford loan (which is almost paid back) to fund my education

 

 

 

these were not a parent plus loans, from what I can tell is they were chase private loans.

I just wonder why they're not showing up as student loans on my credit report like the other ones are and if these are technically private loans that can be discharged in BK since apparently you can use these loans for anything (car,laptop,housing, etc)

 

I know I have 2 routes, 1) filing for bk if possible or 2) trying to fight and ID theft charge when the person who would be the suspect has passed away. I can't figure out which would be the best route
