Please advise if this CA provided proper validation:

 

Mother accompanies adult daughter (uninsured) to dentist for dental work.

 

Mother tells dentist that she will help with some of the daughter's dental expense.

(verbal arrangement only, nothing signed by mother)

 

Mother made several payments, and then alerted dentist that due to conditions that her daughter failed to abide by, she will no longer be providing any more help with dental bill and to contact daughter directly.

 

Dentist immediately sends mother to CA for unpaid amount, and CA sends demand letter for payment.

 

Mother sends Validation letter to CA claiming that it isn't her bill, as she was never a patient of the dentist.

 

CA follows up with daughter's statement/invoice for dental services, and copy of a separate letter that mother wrote to dentist that she will no longer be helping her daughter, and to follow up with daughter for collection of unpaid balance.

 

Mother follows up with 2nd letter stating that what was sent is not proper validation, and to cease collection efforts.

 

CA provides her with daughter's statement once again, and a notice that: "we will honor your request to cease communication, but please be aware that CA reports monthly to all CRAs, and she has the right to inspect her credit files..."

 

Is this a violation? Is this proper validation?

 

Where does Hipaa come into play here?

Your daughter gave permission for you to obtain her medical records and your name was entered into the system. Your payments "validated" your relationship and your liability for the payments. There is NO HIPAA violation. They do not need your SS# to put this on your credit reports, all they need is your name and address and proof of your having assumed responsibility for the bills. Unless you paid in cash, they have a record of either your check or credit card payments.
