Is the verizon $2.00 fee against the credit card companies policy?

I know utilities & governments are allowed to do surcharges for credit or debit cards. Is verizon cell phone considered an utility? I thought it was against the rule for a merchant to charge a fee. To my understanding the Durbin regulation didn't remove that rule.
