Hi everyone,

 

Great forum here. I'll try to keep my question as short as possible;

 

In April of 2007 I filed a consumer proposal in the Province of Alberta. One month later I fell gravely ill and returned to my home province and have been on disability ever since.

 

I always believed that a consumer proposal was considered annulled if no payments are made for 3mths or more. I did not get to make any payments on this proposal thus though that in the summer of 07, it was annulled.

 

Now its November 2011 and I recieve a letter stating that my proposal was just annulled in October, now reinstating my creditors rights. This has reset the two year statute of limitation on these debts I would imagine.

 

I really do not know what to do as my financial situation is dire. Looking back, bankruptcy was the best option.

 

My question is, can a trustee really wait this long to annull a proposal and can I challenge it? Is there any point really?

 

I thank you for your help and opinions. This is really stressing....
