How old is the account?? ( date of service)I followed all the guidelines of WhyChats Hippa dispute process and hit a roadblock at the pre-hippa letter. Experian sent me a letter with the "Section 611 (a)(3)(A) refusal to investigate" in response to the pre-hippa letter ( Sent CM, not RRR, yellow paper w/ teal pen, I've opted out and old addresses deleted ) What is my next step? Should I file a FTC complaint against them? OCR complaint against them?
Is the account ONLY on Ex??
The next step is the medical DV to the reporting CA
http://www.whychat.5...cavalhipaa.html
Then the follow up dispute to Ex

Thanks for the help WhyChat. It's on all 3, about to send off the other two ( Had open investigations with the other two and didn't want to tack on another 15 days for them ) From what I read it's much more likely that Equifax and TU will delete after pre-hippa, I will update this when I hear back. Service date was 11/07/2006. The CA has previously ignored validation requests, I'm assuming they will do the same this time but I understand the reasoning for sending it. Two questions:
(1) As I have already fully C&D'd the CA do I need to add anything to the letter?
(2) Where it says "on any account that may be time-barred as well as in violation of (name of your State) medical privacy rules." Do I put down my current state ( Washington ) or do I put down where the service was provided? ( New Hampshire )
Thanks.

Thanks WhyChat. The collection agency received the letter October 16th. How long should I wait to send the letter to Experian? 30 days?

Okay, sorry for the delay. I've attached a copy of Experian's response:

Is this an account that was deleted from all the other CRAs??
If so, file an FTC complaint against Ex

No, it's reporting on all 3. Experian refused to investigate. Equifax came back as verified along with TransUnion. Should I now do the HIPAA letter for Equifax and TransUnion as I have established a current relationship? and go the FTC route with Experian as they aren't investigating? Also, this is for a anesthesiologist bill. Does the HIPAA letter go to the hospital I had the procedure at or to the company that handles the Anesthesiologist billing?
Thanks.

You opted out??
You deleted old addresses??
You sent the initial dispute letter to all CRAs where the account(s) are reporting?
You did NOT get the account deleted from ANY CRA??
You did NOT receive data from the reporting CA IN RESPONSE TO YOUR DISPUTE TO THE CRAs??
If so, then the next step is the medical DV to the CA
http://www.whychat.5...cavalhipaa.html
and as soon as you have proof of their receipt, the follow up dispute to the CRAs
http://www.whychat.5...aa.html#DISPUTE
IF, on the other hand, you DO have proof and documentation of a CURRENT business relationship between the reporting CA and the OC, you can then pay the OC with the HIPAA letter insert "a"

Yes, I've opted out and deleted old addresses. The Experian letter above was a response to the followup to the CRA's:
http://www.whychat.5...aa.html#DISPUTE
Experian is refusing to investigate and the bottom feeding collection agency isn't responding. I will be using insert C ( Not mine ) So should I now send the HIPAA letter? Do I send it to the hospital or the Anesthesiologist group who is handling the billing? Should I go the FTC route with Experian? Again, Equifax and TransUnion came back as verified. Thanks.

You NEVER NEVER NEVER use insert "c" unless it is for FRAUD and/or IDENTITY THEFT.
Are you saying that you disputed ( after opting out and deleting old addresses) to all 3 CRAs with the initial dispute letter:
http://www.whychat.5.../hipaadisp.html
That all 3 CRAs verified the account??
That you sent the reporting CA this:
http://www.whychat.5...cavalhipaa.html
and then sent each CRA this?
http://www.whychat.5...aa.html#DISPUTE
and that ALL 3 CRAs still refused to delete and you received nothing from the reporting CA?? And that this is for a medical account from 2006?
I suggest that if you have skipped ANY of the above steps, you start all over.
Please make sure you have followed the instructions about the font etc. in the initial dispute letter to the CRAs. What I think MIGHT have occurred in your case is that you had so many things going at once that you wound up trapped in the CRAs automated computer response system.

Thanks for the reply. LOL, I won't go with insert C then, I will go with insert B. I did follow all steps, in the order you just laid out. Handwritten on yellow lined paper in teal, etc. Certified no RR, etc. I do believe your correct about the automated response system. TransUnion and Equifax verified the account, Experian refused to investigate. Should I go the FTC route you previously mentioned with them?

I am not sure but I THINK part of your problem MAY be with your "daily pulls" with a 3rd party credit monitoring service.and as of today I have the old addresses removed ( Again ) from Equifax and TransUnion. Experian still won't delete ( Automated phone or by mail )
I don't believe that those reports are accurate or even correctly updated.
Do you have individual report ID #s??
If so, go on line to each CRA and click under "new dispute" ( DO NOT ACTUALLY ENTER A NEW DISPUTE). Print out your current report directly from each CRA to see what is REALLY going on.

I checked them individually and it shows my old addresses as deleted and the medical bill is showing up on all 3. Only Experian shows an old address because they won't delete.

I don't know why you are having problems getting this deleted.
This is from a Dr?? or from a Hospital??

Do you have any records of the original bills??
What KIND of hospital was it, if it was a hospital, was it a State or County hospital??
What State are you in??

This is the Anesthesiologist's bill, which is handled by a Anesthesiologist billing group ( Not the hospital ) The procedure was done 11/07/2006 and it shows as first reported July 2007 on my reports. I had no insurance at the time and I do have the original bills. I'm not sure if it's a state or county hospital:
http://www.stjosephhospital.com/ ( I would guess state )
I currently live in Washington State, the bill was incurred in New Hampshire.
