Ok, I have read the instructions and just want to clarify what I need to do.

 

DH has two medical collection accounts showing on his credit reports.

 

One is a paid account that was paid back in 2004.

 

The other is an open account from 2008 - amount due $175. That account is our deductible amount for one of our children's ER visit. I had disputed with the hospital about the validity of the debt due to medical misdiagnosis - they still sent it to collections - then we submitted the same documented to the CA - they said they would investigate and get back to us if we still needed to pay - they never did, but went ahead and sent the information to the credit bureaus.

 

For both accounts do I send the initial PreHippa letter? These are the only derogatory items on his credit report and is killing his credit score!!!

Make sure the DH Opts out FIRST:

Attempt to delete any old addresses if possible (if they don't delete, you can still continue to the next step)

 

THEN send the pre-HIPAA letter:

I sent out the 5 letters last week. Today in the mail we got a response from TransUnion.

 

BOTH Accounts have been DELETED from the credit report!!!!!!!!!!!! They only bad items on the TU report are gone!!!!

 

WOW!!!!!!!!!!!!!!!

 

Waiting on responses now from the three other letters - 2 to Experian and 1 to Equifax.

Experian's response to the Pre-Hippa letter sent per instructions and personalized stationary with purple italicized ink and handwritten envelope:

 

"We received a suspicious request your personal credit information that we have determined was not sent by you. This could be deemed as deceptive or fraudulent use of your information. We have not taken any action on this request. Any future requests made in this manner will not be processed and will not receive a reponse. Suspicious requests are taken seriously and reviewed by Experian security personnel who will report deceptive activity, including copies of letters deemed as suspicious, to law enforcement officials and to state or federal regulatory agencies."

 

They want me to call and report and inaccurate information.

 

What is my next step? Do I resend the Pre-Hippa letters to them? How did they determine it was fraudulent if it was in fact sent by us?

FInally received a response from CSC (sent to equifax) today.

 

They state that "the disputed item is not reporting on your CSC credit services credit file," however it is right there on page 8 of the report they sent us and it shows that "consumer disputes this account information.

 

Now what to do I do with that??? scratching my head....

As a followup to my post: On the inital letter, the whole account number was not listed.

 

On the original report I received, the account number was shown as (example) 765xxxx and that is how I addressed it in the letter.

 

On this report received today, the account number is shown in full. Should I resend prehippa with the full account number on it?

The CRAs are just not making this easy on you are they?

I would resend your original dispute, don't worry about the account number along with a copy from your CR that CSC just sent you with the account circled in red. If you have a monitoring service check, the account may have been deleted or if you can check through the "back door" to see if it is reporting or not. It is possible that the account was deleted and you were sent a report that is a few days old.

No, they aren't are they!!!!

 

Ok, I will resend the prehippa to CSC with the copy of the report they sent me with the item in question circled in red.

 

I don't understand how they could possibly tell us it's not on the report and then send a copy of the report clearly showing the account!!!

 

What a pita......wish certified mail was cheaper!!! :clapping:

Okay, today's update!!

 

Received a response from CSC (equifax) regarding the prehipaa letter.....They say:

 

"The medical collection account reported to CSC do not meet the definition of "medical information" as the term is defined in Section 603 1 of the FCRA."

 

It does not indicated that they have validated the debt in anyway. The reporting date on the account was updated to 1/22/2010. We did receive a phone call from the collection agency several weeks ago. Of course, no information was discussed on the phone and all communication was asked for in writing.

 

Experian has still not responded to the remail sent out in December.

Last week, DH got a call from the collection agency. He did not speak with them other than to say please submit all information in writing.

 

Today in the mail we got a response from Experian that says:

 

"If you question the results of our investigation, then you may want to contact the data furnisher directly. Please refer to your original personal credit report for the business name, address and phone number (if available) of the source that verified the information."

 

This is the first correspondence received from experian since we sent the proof of identity information back in December.

 

What do we do now? How long before we hear about the FTC compliant that was filed?

Experian responded on February 22nd with this response (from the February 17th letter which was the copy of the FTC complaint with the other paperwork as instructed):

They have not provided any results of their investigation as yet. Just this one sheet with the above statement. When I pull up an updated Experian report, the paid account is gone and the unpaid one shows a new reporting date.

Ok, Medical DV letters ready to go out - addressed to the one collection agency with two letters, one for Equifax and one for Experian to be mailed CMRR. (just one account showing on both report for both with same CA).

 

Will send out the follow up letters to the CRA when the green card is received back.

Today in the mail, I received a response from Experian dated 2/24/10 stating that the disputed medical account has been verified and will remain on the account. Only took two HIPAA letters and a FTC complaint to get a response.

Green card received today from CA - followup letters to be sent out to CRA's today. Do I send a copy of the letter sent to the CA with each followup letter?
