It has been almost a year since our last payment. We have moved out of our home a little over a month ago. We have told the lender (country wide..now bank of america) that we want them to forclose. Also we are in the middle of bankruptcy. Still nothing.

 

We just want to be done and over with.

 

We owed $200,000. The house is worth $155,000 (plus needs about $10,000 or so worth of work).

They can't foreclose legally, while the bankruptcy stay is on the property. The bankruptcy attorneys should have told you, but they will leave out the details sometimes.

Now the court will have to lift the stay, before Bank of America can proceed. You can also ssk your attorney about surrendering the property.

I've been waiting for CW/B of A to foreclose on mine for 18 months. They still haven't and keep saying they are working on a modification. At this point I too would just like to be able to move on.

How quickly did you guys move out? My last payment was in August and I just filed for BK. I am hoping to stay in my house as long as possible. Cant pass up free rent. I year would be great, any more than that is a bonus, money in the bank. I plan on moving out of state once I do get kicked out so need as much money saved as possible.

We stopped paying in November 2008. We filed our bankrutpcy the end of August. The main reason why we didn't stay in the house because our attorney said we needed that payment for our means test. Without a monthly house payment, we had to much money left over at the end of the month. We wanted to stay longer and save up.
