I am trying to delete some late payments off my credit file. I have had them all deleted by EX, but they still remain on TU and EQ. I wrote some GW letters to the president of the student loan company and I emailed her as well. I got her info by googling her name. She quickly responded that she was going to look into the matter; however, I am not too convinced this will fix the matter.

 

 

 

I spoke to my attorney today, and he suggested I read all documentation I had from my schools and lenders. I did. I noticed that on the Master Promissory note I pretty much waived my rights to the Privacy act by allowing the Department of Education to allow lenders to disclose any information to pretty much anyone (including CRAs). With this information in hand, I wrote a letter to the DOE letting them know that I rescinded my authorization to waive my Privacy Act rights. I advised them that they had permission to disclose only to US Government agencies and not employers, family members, or financial institutions as stated in the promissory note. I then sent a letter to TU advising them that my Privacy Act was being violated since I had just rescinded my permission to the DOE to disclose any information about me to the credit bureaus or anyone not considered a US Government Agency.

 

 

 

I am waiting for a response. My attorney thinks this will fly since I am not rescinding my loan just permission to disclose information about my loan.

You cant change ANY of the terms of your note....PERIOD. Guarantors are required by federal law to report to credit reporting agencies....that is part of the requirement of their guarantee. So you know where that letter will be filed.
