See: The Arbitration Trap: How Credit Card Companies Ensnare Consumers

This report details how arbitration firms and credit card companies enjoy a cozy, mutually beneficial relationship at the expense of consumers they force into binding mandatory arbitration. Using data from California, the findings provide a glimpse of how arbitration traps consumers throughout the country in unfair, secret proceedings where for-profit arbitrators make the rules.

Public Citizen's research uncovered consumers who spent years fending off collection agencies, cleaning up identity theft messes and struggling to bounce back from credit rating hits.

I haven't tuned into the show as of yet, but I am going to tomorrow. I REALLY wish that I would have checked out this thread in enough time to have known about the attorney, Robert Sola being a guest.

I have been dealing w/ the CRA's regarding the exact same situation as the "identity mix-up" case. I have been dealing w/ this for the last year and it is driving me completely insane. No matter how many times they correct their error my file keeps getting mixed up over and over again. They have absolutely NO plan in place to keep it from continuing to occur. I have had to spend all of my free time on this issue for the last year!

I would have really loved to ask Mr. Sola for a bit of advice when dealing with this type of problem. I will be sure to tune in this Thursday, it sounds like it will be very informative.

Yes, Robert Sola was an excellent & insightful guest that we plan have have back on the show this summer. You can listen to his original show appearance by going to listentospotlight.com and scroll down to his show. (all previous shows remain in our archive for download or listening at your convenience.

I would take a listen to his show and then get in touch with him. He represents clients with your same (and typical) problems.

Thanks for the comments!

Denise

P.S. Tomorrow we have a show aimed at helping families of the military.

Can I give my opinion in order to spur some discussion/action regarding collection agencies? I think they should automatically validate any thing they report to CRA and send documents with their collection letters to the alleged debtor from day 1, including whether they own the debt or not. This would cut down so much on trouble for everyone involved. I would like to see this type of legislation of rules for collection agencies.

I agree! I don't think the cra's should be allowed to put negative data into our credit reports until we are notified of the pending information -and have a right to dispute it within a reasonable time frame.

It would save a lot of time, money & frustrations!

In fact we have a show coming up on the 17th on debt collection practices & consumer rights:

July 17 @1:00 PM EDT

"Meet two of the most respected Alabama consumer protection attorneys, John Watts and Stan Herring (AlabamaConsumer.com) Learn what your consumers rights are when dealing with abusive debt collectors and the credit reporting agencies."

July 10 @ 1:00 PM EDT

Eric Drew (drewfoundation.org) was in the hospital fighting a battle with cancer when he soon learned he had another battle to fight...he discovered his identity was stolen by a hospital lab tech! Guests include Jay Foley from the Identity Theft Resource Center and credit reporting expert Attorney Robert Sola, with the National Association of Consumer Advocates. (NOTE: Attorney Sola's previous appearance is in our archives and is one of our most listened to shows: An FCRA Consumer Attorney Reveals why Consumers Sue the CRA's.)

July 3 @ 1:00 PM This week...

Ira Rheingold, Executive Director and General Counsel of the National Association of Consumer Advocates (Naca.net) and Janet Ahmad, President of HomeOwners for Better Building (hobb.org) discuss the costly, unfair and harmful effects of binding mandatory arbitration. If you have questions you can email them or phone into the show: Call-in Number: (718) 664-6583

Also at the beginning of Thursday's show, we will discuss this latest deceptive practice going on by the cra's! See: A New Form of Identity Theft and my comments about it at Give Me Back My Credit.com/blog

Someone is Tamering with my Identity... What do you think?
