Hi guys,
A while back this number: 866-350-8346 called me, and informed me they were trying to collect on an 11-year old account that is no longer on my credit report. I have yet to receive anything in writing from them, yet they continue to harass me. I am having a hard time finding their actual business info. and the co. name I have is based on a google search so it may not even be correct. Does anyone know who these people are or how to get them to cease and desist? Also, since I never got anything in writing from them (which I heard is illegal), what should I do from here?? Thanks! grin.gif

I will try to find their address for you. Mean while opt out and delete old addys. Next do not let these people rattle you. The alleged debt is out of SOL so they can't sue you, put it on your CR and make you pay. We call this collector a Junk debt buyer (JDB). Go to Whychat's site and look up your State SOL and start working on the SOL letter from his site.

LOL I filed with them earlier also. Actually, You can register a complaint with the FCC if the person is calling you too often and will not stop. I did it with MCI once and it worked like a dream wink.gif

Here's the escape route
The following letter is the first step in disentangling oneself from the clutches of this outfit.

The next step – if they are not thus dissuaded – will be to appeal to the victim's State's Attorney General office and the American Collectors Association and his or her local State Bar Association for instructions as to how to file, the proper forms to do so, and what other information is pertinent .

The branches are itemized below this letter.

By Certified mail - return receipt requested

[Date] , 2009

[Name and address of relevant Christensen branch]

Re: [Name of creditor]
Account # ______________

To Whom It May Concern:

This will serve as your legal notice under provisions of federal law, the Fair Debt Collection Practices Act (FDCPA), to cease all communication with me in regard to the debt referenced above. If you fail to heed this notice, I will file a formal complaint against you with the Federal Trade Commission who is responsible for enforcement, the State's Attorney General office and/or the American Collectors Association or local State Bar Association.
You are also notified that should any adverse information be placed against the credit reports as a result of this notice that appropriate actions will be taken. Give this very important matter the attention it deserves.
Sincerely,

Hi there I was wondering if you could help me?

My mom just recently passed away in October leaving behind nothing but a few small credit card debts. Sense then Ive been receiving letters and calls from this particular place stating that i as executor of the "estate" am liable for the balance. As far as i know I am suppose to send a death certificate along with proof that there is no actual estate. This seemed to work for the most part excluding a few inquiry's about it for almost all of the different places except this one. Ive gone though sending a death certificate 3 times so far and the only response i receive is more collection calls/letters. Ive tryed to call the number listed in the letter 866-768-5813 to only get a machine with a few options revolving around make a payment or set up a payment plan. The only time I'm able to get to talk to someone is when they call my house. They go though a lot of questions mostly going back to you can settle the debt by paying it off. From there i try getting it though to them that I'm aware I'm not liable for the debt and they tell me to send a copy of the death certificate to there fax number that doesn't seem to actually go though. the process just starts all over from there. I'm at my wits end I was wondering if the above steps would work for my situation or is there additional steps i should take to clear this up.

Thanks in advance for the help

If there is no estate, you are not personally liable for any debts that she may have incurred. In fact, you are not personally liable in any event.

Right. Tell them not to call you any more, that you will not pay this. If they continue, get their address and send them a letter telling them to stop calling you - with proof of delivery. If you know which collector it is, or have their phone number, we can probably give you their address and you can just send the certified letter. Don't talk to them any more.

I'm sorry for your loss. It is difficult to lose a parent.

Sometimes when you get a call from a number go to http://whocalled.us and type in the number and you may be able to find out who it is from but nothing is 100%.
