Has anyone read the new 2005 book by Chuck Stewart titled: Bankrupt Your Student

Loan And Other Discharge Strategies? Any reviews?

I have spoken with the author and seen his case. He had $60,000 reduced to $6,000 in CA Federal Court.

besides...why buy a book that will take you days to read when it can be summed up like this:

 

 

Federal law allows SLs to be discharged in certain circumstances, such as undue hardship.

 

 

 

 

then the book will likely go on to tell you how to hide assets and income to "prove" the hardship...

ok Chuck. I'll tell you why: because your book preys on those who hope to discharge SL when in fact there is a very low probability that SL can be discharged. Stop ripping people off.

I used to work in the student loan industry. Gave 'em out and collected them. According to my contacts in the student loan industry, the book is basically a cut and paste of information that is available free of charge on the web.

 

You likelihood of discharge in negligable. The Reynolds case, which the student loan industry is aware of and are not happy about, had so many mitigating circumstances. The mental illness was the clincher although I have seen many cases where mental illness was a factor where the loans were not discharged.

I came in here in good faith and have extensive knowledge and research in this area.

 

I have been researching this for over 3 years and the law is constantly evolving in this area. I have read dozens and dozens of cases decided over the last 8 years where student loan debtors have been able to partially or fully discharge their student loans and in other cases have been able to settle for pennies on the dollar.

 

The student loan industry depends on their "very tough reputation" to intimidate people. This forum appears to be spreading that word. It does everyonea disservice by doing that. Perhaps it takes a fresh point of view to point out an error. Hmmmmmmm?

 

BTW the poster Hegenomy has done nothing but attack me without cause. All I did was ask him/her to back up their attacks with factual information.

 

Also, you challenged me on my knowlege of student loans and bankruptcy and I accepted that challenge. When do we get started on that?

You are a GUEST in the house of CreditBoards; you have chosen to sit at OUR table and then you come in and start insulting the members of this board, this forum, AND the forum lead without much of a premise. You have no idea how much or how little knowledge anyone in this forum has, and NO ONE has any idea how much or how little knowledge you have about anything at all.

Got it? You keep claiming all this extensive knowledge on student loans, let's see it. Cite the cases you've read that give you the knowledge that NO ONE ELSE here has. Chapter and verse, please.

Wow...dozens and dozens full or partial discharges in eight years?? Still about the same odds as winning the lottery. When I worked the DOE as a client we would get in dozens and dozens of filing per week!!

 

Maybe insteading of wasting valuable time trying to fight a loosing battle, you could get a second job and pay your loans. I'm sure that someone as highly intelligent and well read as you could easily do well.

Again, the law is constantly evolving and changing in regards to this subject.

 

Of course you got dozens of filings a week. People with SL debt are also likely to have other debt and when they file they have nothing to lose by including their student loans on their petitions. Your analogy to the lottery would be more apt if it included people who knowingly picked up losing lottery tickets from the sidewalk.

 

Reading, researching and examining the cases that have won or have made excellent arguments in losing is the only way to go.

 

I have over 40 excellent cases on file and have read through probably ten times that amount.

 

You are doing a disservice by taking such a "belly up" attitude towards thses student loan lender Flower Pots.

 

We need positive, gutsy people in this fight, not wusses who are willing to roll over.

Student loans are ultimately funded by our tax dollars. Discharge is there for those who need it and who qualify for it. You are semi intelligent and if you are capable of understanding and researching the law, you are capable of working. Unless of course you have made a career out of screwing the government and the taxpayers.
