South Dakota Lemon Law

 

A motor vehicle ‘lemon law’ enacted in 1993 enables consumer, under certain condition, to obtain either a replacement or a refund for their new car, light pickup, or motorcycle. A condition that does not conform with the vehicle’s warranty and is identified by the consumer within the first year after delivery or the first 12,000 miles (whichever occurs first) is covered. If the condition has not been repaired after four or more attempts and significantly impairs the use, value, or safety of the vehicle and arises out of normal and ordinary use, then the consumer would probably be entitled to a replacement or refund. For a refund, there would be a reasonable allowance for the consumer’s use of the vehicle.
