New Mexico Lemon Law

 

The Lemon Law applies to all new cars, pickups, motorcycles, and vans sold in New Mexico after January 1, 1986. If after a “reasonable number of attempts,” the dealer is unable to fix the car according to the express warranty, the manufacturer shall replace the car or offer a refund of the full purchase price, which is to include all taxes, license, title and registration fees paid, and other collateral charges. The manufacturer may deduct from the refund price or replacement a “reasonable allowance” for the use of the car. A “reasonable number of attempts” is if the same problem has to be repaired four or more times within the express warranty period, or one year, whichever is sooner; OR if the car is at the dealership for all repairs, excluding normal maintenance, a total of 30 business days within the express warranty period or one year, whichever is sooner.
