Minnesota Lemon Law

 

 

NEW CARS - The manufacturer or its authorized dealer must repair the motor vehicle in accordance with the terms of the applicable written warranty if: (1) It has a defect or problem which is covered by the applicable written warranty; and (2) The defect or problem has been reported by the consumer within the applicable warranty period, or within two years after delivery of the vehicle, whichever comes first, If the manufacturer or authorized dealers have been unable to repair the problem after four or more attempts, OR one unsuccessful attempt to repair a defect which has caused the complete failure of the steering or braking system and which is likely to cause death or serious bodily injury, OR the vehicle has been out of service for warranty repairs for 30 or more cumulative business days, then under the law, you may go to court or through the manufacture’s arbitration program to seek a full refund of the purchase price, minus a reasonable deduction for your use of the vehicle. If the manufacturer offers a replacement vehicle, you can either accept the replacement vehicle or choose a refund. You must notify the manufacturer, zone representative, or authorized dealer in writing. USED CARS – The Used Car Warranty Law became effective August 1, 1988. This law requires used car dealers to provide basic warranty coverage for most used cars and small trucks sold to consumer in Minnesota. The terms and duration of the warranty must be disclosed on the FTC Buyers Guide Window sticker. If a car is not covered by a warranty, the “as is” box must be checked. For covered parts, etc., contact your local DMV office. Dealers may with to contact either the Minnesota Auto Dealers Association or the Northland Independent Auto Dealers Association.
