help please

Hi

 

Let me start with I am so glad I found this board, and now realize most of my mistakes.But I just dont know exactly how to handle this problem.

 

I have a problem with a charge off . What happen was a young girl ran a red light and totaled our car that we had not owned for a year.Her Insurance paid for the first portion, gap insurance picked up the balance and the car was paid in full .

We have had some heavy medical struggles(brain damage/broken verdbrea ) after the accident, and until a few months ago I never paid attention to our credit report(another mistake) Because we owned 3 cars at the time, loosing one was no huge problem and because of the medical problems of the accident I didnt think it was a good time to take on another loan.

 

Well when we went to get a loan a few months ago, I found out the car was listed as a charge off/ written off 1022 and I freaked. I disputed this as the car was paid off and this was not a charge off . Now it comes back as paid/charged off/ written off 1022, claiming this was done in Oct of 2003 on Equifax, Nov 2003 with Experian and TransUnion in the single report says paid as agreed, but on the 3 in one says derogatory. The accident was in mid Oct of 2003 and prior to that all payments were on time paid as agreed.

 

When calling ( I know now mistake) the OC I was told because the first insurance company didnt pay off the entire car, the balance was then charged off. Even though they knew we had gap insurance, and they needed to provide us with a 480 warranty refund amount before we could determine what the end balance was for the gap insurance to pay. Our attorney was handling the car pay off and being our first accident ever dummy me thought everything was ok.

 

How do I get this charge off out of my file.Being the vicitm of the accident was bad enough, but this has ruined our credit and they are saying that they are correct in doing so. BTW this never went to a CA.

 

Can anyone out there help me or am I just scr**** ?

 

I am so frustrated I could cry.
