Idaho Lemon Law

 

The lemon law covers new motor vehicles that are subject to applicable manufacturer’s written warranty. Vehicles must be purchased or licensed in Idaho; weigh 12,000 lbs. Or less; and be used primarily for personal business or personal, family, or household purposes. The law applies for the length of the written warranty, 24,000 miles, or two years, whichever comes first. If the manufacturer, its agents, or its authorized dealers are unable to repair or correct a vehicle’s nonconformity after a reasonable number of attempts, the manufacturer shall either (1) Replace the motor vehicle with a comparable motor vehicle; or (2) Refund the car’s purchase price less a reasonable allowance for use. A manufacturer will be presumed to have had a reasonable number of attempts to repair a motor vehicle if, within the applicable warranty period, two years following the date of the motor vehicle’s original delivery to the consumer, or 24,000 miles, whichever occurs first, one of the following are met: (1) there have been four or more unsuccessful attempts to repair the same defect and the nonconformity continues to exist or (2) There has been one unsuccessful attempt to repair a defect which has caused the complete failure of the steering or braking system and which is likely to cause death or serious bodily injury; or (3) The vehicle has been out of service due to warranty repairs for 30 or more cumulative business days. Note: The manufacturer shall have at least one opportunity to cure the defect before it is presumed a reasonable number of attempts have been undertaken to repair the vehicle.
