Anybody had this before? We did a refinance in 2000. Went over everything explicitly with Broker. Plan was to do a 2 year pre-pay penalty and refinance in 2 years. Service came to our home and we signed docs. He left copie of unsigned docs with us. Next day we were contacted by Title Co. telling us he had us sign wrong papers, they were going to send us new papers to sign to throw away first set and send new signed ones back ASAP. We did, but I, thank God, kept first set too. Docs arrived and I put them away. Did not read. Now that we are looking into refinance we have been told that we have 5 year pre-pay penalty. I got out both sets. First set has 2 years and last set has 5 years. Broker will not speak to me. He knows it was 2 years. ANY SUGGESTIONS? Thanks to you Willie I have filed a complaint with State Atty General. :cry:

And remember the Ca state Department of Financial Institutions....go get em Angie! We have already talked about this but others will come by and comment about it. We have a great group of Mortgage people, credit goo roos, and other professionals here that will always help. :wink:

In addition to problem with mortgage broker, I have discovered after reading documents with a fine tooth comb, we did reinance in 2000, I am finding many other discrepancies. We were provided a second "corrected copy of docs and asked to toss out first set whic I kept. My question is it the mortgage broker, title company or lender that I need to go after and file complaint. Do I hire a real estate attorney? Also we are supposed to pay a post petition amount to mortgage company by 9/19 2003, If we don't have the full amount what can we do. This gets worse and worse. Welcome any advice. :!:

I remember you have already spoken to a RE attorney and wasnt getting anywhere fast, yet was costing you..if the AG and DFI offices arent helping you let me know and we will go to phase 2 on this bad boy

This creditboard is the best thing that has happened to us since this mess began. The people that participate are fantastic and helpful. I have spent all day printing valuable information.

 

I had found a another forum and when I posed this same question the responses I got were, "Youre a deadbeat" Your a loser" "Pay your bills quit sticking your creditors" that was the response for anyone in BK. I think everyone there was "stuck on stupid"

 

Well I know that sometimes people have things happen in their lives that are beyond their control. I thank everyone here for so many helpful hints.
