David Shulman, an attorney in Fort Lauderdale, Fla., whose practice focuses on trusts and estates, says there's no obvious reason to link the home transfer with an attempt to protect assets or do an end-run around prospective creditors. In Pennsylvania, Shulman noted, as long as the property is held jointly -- as Paterno's was -- it can't be subject to the creditors of just one of the spouses. And since Sue Paterno hasn't been linked at all to the sex-abuse scandal, she has no liability or exposure.

 

"I haven't seen the documents," Shulman said, "but from what's been made public, it just doesn't make any sense that this was an attempt to protect assets."

 

Then what was Paterno up to? Shulman said the 84-year-old Paterno's decision to transfer the house more likely had something to do with age-related issues, such as Medicaid and tax planning. To qualify for Medicaid-covered nursing home care, for example, a recipient must "spend down" to a certain level. And people are constantly looking to protect their assets from taxes to ensure that their heirs inherit as much as possible.

 

Since Paterno has good insurance and a degree of wealth, he probably didn't do it for Medicaid purposes. Far more likely it was done as an estate planning move to avoid probate, said Shulman. "It is a fairly typical thing for people of means to want to protect their assets for their children or whoever will inherit them," he said.

 

 

 

ETA: To me, the house transfer does not seem shady.

 

 

perhaps not but it adds to the materiel all the tell-all books that will be written can use to speculate.

Former Penn State coach Joe Paterno has a treatable form of lung cancer, according to his son.

Scott Paterno said in a statement provided to The Associated Press by a family representative on Friday that the 84-year-old Joe Paterno is undergoing treatment and that "his doctors are optimistic he will make a full recovery."

I don't think Joe signing his house over to just his wife meant he was preparing for legal battles. JMO.

 

Did you hear that new kid who came out and said that he felt uncomfortable with Sandusky, that he showered with him, Sandusky put his hand on him, wrestled with him (in the shower, was my impression) but that Sandusky never did anything else? That when Sandusky asked him to testify on his behalf he turned him down???? Speaks volumes in my opinion. He said Sandusky was possessive, or at least eluded to that.

The allegations towards accused Penn State pedophile Jerry Sandusky continue with his grandson now coming forward with claims of sexual abuse.

 

A complaint was filed against the former assistant coach by the wife of one of his adopted sons, Matt Sandusky with Pennsylvania's Children's and Youth Services, his lawyer told ABC News.

 

“The allegations are ridiculous and unfounded. Jerry has absolutely denied any inappropriate contact with his grand kids.” Sandusky's attorney Joseph Amendola said.

 

Sandusky's daughter-in-law filed for a restraining order after his November 5 arrest to prevent her children from sleeping over.

 

Sandusky has been charged with abusing eight boys of 15 years. He is currently out on Bail awaiting trial.

 

 

I have to be honest, I wondered if it was the son, Matt or if it was one of his kids....

I hope that this arrest sticks and he sits, alone, for a long time.

 

I also hope his wife gets charged with accessory or something as I CAN NOT believe that for all those years she knew NOTHING about what was going on. :angry:

NBC News has obtained the complete file on the investigation – the police report and assessments by two psychologists who interviewed the boys -- which provides new details about Sandusky's behavior. It also could raise fresh questions about how school and local authorities handled his case.

 

"There was very little doubt in my mind (Sandusky) … was a male predator, someone that was in the process of grooming a young man for abuse ," said Chambers, speaking publicly for the first time, with the permission of her client's family, in an interview with NBC News. "I thought…my report was strong enough to suggest that this was somebody who should be watched."

"My consultants agree that the incidents meet all of our definitions, based on experience and education, of a likely pedophile's pattern of building trust and gradual introduction of physical touch, within a context of a 'loving,' 'special' relationship," Chambers wrote in her report.

 

"One colleague, who has contact with the Second Mile, confirms that Mr. Sandusky is reasonably intelligent and thus, could hardly have failed to understand the way his behavior would be interpreted, if known," Chambers continued. "His position at the Second Mile and his interest in abused boys would suggest that he was likely to have had knowledge with regard to child abuse and might even recognize this behavior as a typical pedophile 'overture.'"

 

and this part is something I found interesting, too:

 

As a former secretary of public welfare in the 1980s, Cohen had set up a statewide "child-line" registry of suspected child abusers that could serve as a central data base for school officials and others working with children to conduct background checks on prospective employees. Even if there were no criminal charges brought, Cohen said, there was more than enough evidence to have placed Sandusky on the statewide registry.

 

"Jerry Sandusky should have been on the watch list," he said. "But instead, the case was closed."

 

 

Do other states have a Registry of "suspected child abusers" or is this only in PA?I know there was one in PA, but didn't know if other states had adopted this type of registry as well.

Yup Wi has one.. I'm sure all states have some kind of registry set up.

I know there is a SEX OFFENDERS' list, but I meant a "suspected child abuser/sex offender". Are you saying WI has a suspected one along with the regular sex offender list?

I stand corrected, only those that are convicted of a sex crime are registered on our Sex offender list

I don't think it's healthy to have a national registry of those "suspected" of sex offenders. If your convicted, that's one thing. How does the one in Pa work? Is it open to the public? What happens if someone never did the crime then is their name wiped off?

Yeah but that's IF your already convicted.. from what I'm reading from NQH there's a separate one of those "suspected" not convicted.

 

Yes, it is a separate list from the Registered Sex Offenders list for people who have already been convicted.

I have tons of questions how this happens. I can argue both sides of it. Had Sandusky been on a list of suspected child abusers...then again, I have issues with some people being on the SOR (sex offender registry) for urinating in public. kwim?

 

If other states had this registry that apparently PA has, I was going to ask others here how they thought that worked, etc.

I don't think that a "suspected" list would pass Constitutional muster. If there is credible suspicion of abuse the person should be investigated at the time, not blacklisted for later.

I understand what you are saying.

 

Maybe I am reading that article wrong, but I am interpreting it to say "Watch List". It APPEARS to have been passed for the state of PA. I am trying to google info on it now because I have NEVER heard of a "watch list" for this. :dntknw:

If it's posted internally, and available to those such as CPS & Cops.. I wouldn't have a problem with a "suspected list". However, a public registry is where I draw the line until convicted.

From the article I am understanding that it would be for schools and others working with children. It doesn't sound like a public thing. :dntknw: I am still googling. lol

Database Unit:

 

This ChildLine section maintains the records of the pending complaint file (alleged child abuse investigations), central register (confirmed child abuse reports) and the unfounded file (reports awaiting expunction). All other sections rely on this unit to provide prior history information to child abuse investigators, fulfill requests for background checks, and statistical data for reports.

 

Verification Units:

 

The CPSL requires prospective child care service and school employees to obtain child abuse clearances from the Department to ensure they are not a known perpetrator of child abuse or student abuse.

 

Child care agencies are prohibited from employing any person who will have direct contact with children if the individual was convicted of certain criminal offenses or was named as a perpetrator of a founded report of child abuse within five years preceding the request for a clearance.

 

That would most likely have prevented Sandusky from being at Penn State or working with this "charity"???
