Hi, I'm back :wave:

 

I have no new med collections but still have a few remaining. I decided to just hold off on the ones that have been paid and updated as paid on the reports. I've had so many other things going on for the past several months. There is 1 that I disputed, Med DV'd and finally received a response after several months. It was verified quickly (within 30 days) with the CRA's but I didn't get the statement/proof of relationship for months after the DV. I put it on the back burner and hadn't thought much about it.

 

Then hubby and I app'd for a mortgage and were told that we should pay that final collection (this is the only 1 that wasn't paid during the hipaa process because I hadn't received anything from the CA). After the mortgage broker said that I called the OC to try to pay them and they of course said to call the CA. I did but never got through to anyone. Then yesterday I got a call from the CA and she was so rude! Ultimately, I told her I didn't have time for her and to send me the bill statement. I really don't know what compelled me to say that, but I said it. So, I know there is a relationship with the OC, should I go ahead and send payment to the oc w/insert a?

 

Also, the CA called me after the C&D in the medical DV, I thought after a C&D they weren't to call anymore?

Is this account reporting on all 3 reports, or was it deleted with the initial dispute letter from 1 or more??

 

 

 

You can pay it to the OC with the HIPAA letter insert "a", but it will likely not affect your credit report in time.

 

How do you KNOW there is a current relationship with the OC, is it because the CA was notified by the OC of your call??

 

If so, then it is pointless to pay the OC, you might as well pay the CA as there is no way you can avoid having it show as a paid collection, even if you use the HIPAA letter insert "a" as you have established the permitted communication between the OC and the CA.

 

Once you have proof of payment to satisfy your mortgage broker, and once you have closed, you can work on having it deleted, assuming it is reported as a paid collection.

 

You voided the cease and desist by contacting the OC who contacted the CA

It was never removed on any of the 3, actually, it is a joint account and it was deleted from mine completely but remains on hubby's 3.

 

I received the print out of services/billing from the CA, but it was months after I DV'd them. So, I believe that is proof of current relationship.

 

I'm confused now if I should pay the OC or CA? I'm guessing OC though.

 

Live and learn I suppose, I didn't realize that contacting them would void the C&D...and now I know.

If you had time, you could pay the OC, however since it won't be easy to get the payment accepted in time for your mortgage closing, and it will be VERY difficult to get a "paid" collection off your reports due to the communications you have had, I suggest you pay the CA.

Okay, thank you WhyChat. :D

 

I really want you to know that most of our problems were medical and I believe is what kept us from being able to buy a home. Even though it isn't all said and done we're on our way and if we hadn't have found this board and you/your hipaa program I dunno that we'd be able to do this now...so really...thank you for the amazing help and guidance.

I'm back. I just got a call from a CA for a medical account. I am all but certain it has to be a mistake but I'm concerned it is going to show up on hubby's report. We have not received a dunning letter, only the call from the CA. I told the woman not to call again but to send us a billing statement. I requested that before she told me she was with a collection agency. Bottom line is we've been pre-approved for a mortgage and plan to look at houses this week and make an offer asap. I'm freaking out now because of this potential hit to hubby's credit right at the beginning of our house buying process. I don't know the CA's name but I have the hospital name and can contact them but wanted to seek your advice before I do anything stupid. Additionally, this is not on any credit report currently. I was told the service date was 7/2011 (all but impossible as hubby was no where near the city where the hospital is located). Is there anything I can do to prevent it from hitting his credit?

If you don't know the name of the CA, you can find them from a reverse look up on their phone # , the hospital would not be likely to have any record as this appears to be a JDB , if you can find their name,send them the medical DV

Opt out again ( for both of you) as you may have accidently opted back in.

 

It is more than likely that this is a JDB who accessed your old accounts somehow because of your mortgage applications.

 

Sending them the medical DV which has a total cease and desist should keep them from poisoning your reports.

Okay, I did the opt out again for both of us and have the letter ready. I do not have an account number, so without ringing them up I don't know how to handle that. What would you suggest?

Would this be acceptable? "This letter is being sent to you in response to recent communication for an account you claim to hold for medical services provided to Mr. EnC_Plus3"

Ugh, I found the CA and have no idea where to send the MedDV. They have 4 addresses on their contact us page. Of the 4, 2 are in California (where we are), 2 in NV and 1 in WA. The corporate office is in CA. We are semi-near one of the CA offices, not the corporate. Should I just send it to all 4? FWIW its Grant & Weber collection agency.

Send it to the corporate office in Ca. make sure you include your phone # and state that you have no such account with ( name of hospital) and that you will file a complaint against them with the Ca. Consumer Affairs if this unknown account is not immediately deleted from their records. DO NOT SIGN your name, print or type it

 

Use this:

".This

letter is being sent to you in response to a telephone call from your Company on x/xx/xxxx at x:00 PM to my tel.# xxx-xxx-xxxx ,for an

account you claim to hold for medical services provided to Mr.

EnC_Plus3 at ( name of hospital) for a service date of 7/2011 at which time I was nowhere in that City or at that facility"
