One of those people who thinks all CA's are honest guys doing a job that must be done, that the law requires the CRA's to report for 7 years, and that everyone on CB is in trouble and it's their own fault.

 

The last dude we had come around and talk like that, who was honest, came back a few months later, when his ID had been stolen and said "I never realized..." :grin:

 

I wouldn't wish it on anyone, you understand, but it does happen.

I am learning every day that people, no matter who they work for or what they do (at least lately in my humble experience) think that consumers are dumbs as rocks until they get caught or are asked to support thier request.

 

Just yesterday, we dropped my car off at NTB for some tire work. 3 hours later we go to pick it up and as soon as my hubby walks in the door - Dude says - We had to force your door open. Sorry Man.

 

When we realize he actually BROKE the door, we complained to the manager who said... Nope, dude didnt say that YOU misunderstood. I am not fixing it, cause we were in the right.

 

Whatever, so you dont call the owner and say you cant work on it since you cant get into it? You just force the door open, then work on it with the door open the entire time, then leave it next to the road with the door open, the keys in the ignition and in the ON position, the radio and the AC on cold, with the windows down and the Owners dont have a right to be upset?

 

So, we the educated consumers are making sure that this gets fixed and that the powers that be (the ivory tower) know how thier shop acted and that we will not stand for being treated that way.

 

The same principles applies to CA's and most people that we do business with. Get educated, know the laws or rules that protect you and when necessary use it to your benefit. Dont let someone bully you.

I LOVE THIS THREAD!!!

I obviously missed it the first time too...nuttin' left to say, except I might drive everyone nuts at times, with questions...but I WILL NEVER GIVE UP...AND IF I FALL...I WILL GET RIGHT BACK IN THE RING...START THE NEXT ROUND!!! THANKS CB...It is so generous of everyone to share your knowledge. CB is about sooooo much more than "credit repair"...this is an AWESOME place...and am so glad I found it!

After my ficos dropping by 17 this week i needed this thread!!! it is a good boost for my next round of letters. ( i went over limit on two cc , one by $6 and another by $5 ) Paid balance down to 60% on one and waiting on the other bill to arrive. Anyway , great read!

Pryan - I know you've heard this from half the people on this board but you are officially one of my new favorite people. I got your link from another post and I'm printing it out and putting it in the front of my binder in it's very own, very special sheet protector to reside there for all time so whenever I need a pick-me-up I can reread it and laugh until I cry and feel ready to fight all over again. If your post wasn't a "Go Team Go" inspiration to anyone who read it, there's something wrong with them!

I am not rolling over. I am not giving up, BUT

 

I am ashamed to admit this, I have no desire to sue anyone. I am building up a paper trail to have in case they sue me, but since it is an old debt bought by a JDB and is not affecting FICO in a serious way, I seem to be content just answering their letters with a "please validate" alternating with a "the purported validation is not sufficient under applicable law." They have not threatened me with anything yet.

 

My type B personality, I guess.

I admire your passion, but look at it from my perspective...In order to get the 1K, I'll have to pay the filing fee for Federal Court (no way am I going to small claims on this-particularly not in Rockville, MD), spend countless hours drafting a complaint, spend money on a lexus or Westlaw subscription, and have to go to court and deal with obnoxious opposing counsel and stupid Judges. Yet despite all this, I could lose and get a judgment against me on any countersuit.

 

In order for me to go through all that just for principle's sake, the CA would have to be a lot more annoying to me than they currently are.

I'd still have to pay something (filing fee for example) and you are probably right about a countersuit. They would have to bring a new action. It is not SOL yet. I calculate April 2009.

the attorney actually pays the filing fee...

 

 

it's not a third of 1000...

 

it's their reasonable attorney fees...FDCPA and FCRA allow for recovery of that...

 

 

so let's say you win 1000 dollars (and I don't know the specifics of your case...it could be much more than that)

 

your legal fees are 7000

 

filing fees...let's say 300 bucks

 

 

the CA pays your attorney 8300....you get 1000 of that

I just had to jump in. This thread motivated the hell out of me, even more than before.

 

I LOVE turning the tables on these SOB's.

 

They would call and call and call. Now its OUR Turn to turn the tables.

 

I send a new compalint once a week to a law firm and hound the crap out of them. they already filed suit prior anyway.

 

Im gonna stay on em like a rat on a cheeto.

 

They might win, but not by default, and NOT without a hell of a fight.

 

Reminds me of the movies were the bad guys get pissed off cause they cant get the good guys off their back.

Speaking of which, I have a question: Can either OCs or CAs call on Sunday?

 

Here's a typical story of someone who hasn't been here yet.

 

 

1. CA harrasses you day and night for months on end

2. you ignore them, hoping they'll go away

3. They'll keep threatening you with wage garnishment, poisoning your puppy, eating your ancestors, setting fire to your car, causing a meteorite to fall on your home, creating a whirling vortex of demons to haunt your sleep

4. They'll call your friends and neighbors telling them that you're a deadbeat

5. Your parents will get phone calls from them asking how they could have raised such a loser

6. They'll call your boss and tell them that they have a thief working for them

7. They'll sell the account to another CA and it will start from number 1

 

(all the above is real, except for SOME of the threats they make)

 

NOW....

 

 

you're not going to let that happen to you, right? You're a member of CB...so you're going to read here...learn as much as you can...enforce your rights under FDCPA and FCRA, and HURT the bastards. Not just make them stop bugging you, but HURT them. I don't EVER want to hear that you're "just waiting them out, they'll go away". You're NOT waiting for a THING. Let THEM be the ones that want YOU to go away. You're going to push forward, you're going to FIGHT them, you're going to push them back under whatever rock they crawled out from. You're going to make them regret the day the rubber broke and the ill begotten result of their parents nighttime romp was conceived. They're going to FEAR you. They want YOU to be the one that's afraid, but you're not going to let it happen. You're going to strike TERROR into their flabby, black little hearts.

 

After they get your first letter, they're going to stand up on their lemonade soaked hind legs and say "SON OF A mouse, It's another one of those G DAM EDUCATED consumers." He's going to wish that he had taken that job cleaning public toilets with his tongue.

 

Sometimes I actually pity the poor bastards...I feel sorry for the poor, misguided souls that think they're actually doing a SERVICE for society. Sometimes I think that maybe some of them can't help it. Maybe they weren't held enough as a baby, maybe their parents were brother and sister. Maybe the best street corners are taking by other beggars...but don't let emotion get in the way, they are the ENEMY. No mercy for the bastards. Once you get ahold of them by the nose, KICK THEM IN THE flowers. Don't let up. Keep pushing them until they BEG you to stop, then kick them again. Let THEM be the ones to surrender. Let THEM be the ones to cry out for mercy. Let THEM be the ones to hide, hoping you'll go away. When you're through with them, they'll want to dig a hole and pull it back in over them.

 

 

Remember, these jokers are out for ONE thing and one thing ONLY. They're there to seperate you from YOUR money, whether you owe it or not. They don't care about your rights, they don't care about what's REALLY owed. All they care about is taking money from you to put it in their own pockets. In this respect, they're no better than common thieves. The only difference is that they break into your house using a telephone rather than the front door. Treat them as you would treat ANY intruder into your home. Use the laws that are there to protect you and FIGHT. If a stranger came up to you on the street and demanded money that they claimed you owed them, what would you do? Fork it over? Not a chance. You'd demand to know what it's for and why you owe them. If they couldn't prove what they said, you'd tell them to go lemonade up a rope. These CAs calling you are doing EXACTLY the same thing. Don't put up with it. The sooner you realize that YOU'RE in control the better for you, and the worse for them, and that should be the goal...make them MISERABLE...with any luck they'll quit and start doing something PRODUCTIVE for a living.
