UPDATE - soooo frustrated.

 

On my USAA, Equifax has updated the status of the account to "closed - unpaid".

 

In addition,

 

I received a letter from Experian yesterday. It says:

 

"We received a suspicious request regarding your personal credit information that we have determined was not sent by you. This could be deemed as deceptive or fraudulent use of your information. We have not taken any action on this request. Any future requests made in this manner will not be processed and will not receive a response."

 

TU has still not moved.

 

What do I do now?

Send a reply to Experian and include proof of your ID ( copy of SS card and Drivers License) Include copy of their letter to you, tell them that you properly disputed by US mail certified # xxxx on xx/xx/xxxx and that they are in violation of the FCRA and FACTA for refusing to properly investigate your dispute. File a complaint against Ex with the FTC recounting the issue, ie date of dispute date and contents of their letter to you and copy of your reply.

Include a copy of the filed complaint with your reply to Ex.

Trty to get a REAL copy of your updated reports, the USAA reports are "3rd party" reports and very unreliable

Sorry last questions - I am filing the complaint now and they are asking for my SSN. Do I need to give it to them?

 

Also does my reply to Experian need to be in weird font or can it be normal?

Yes, of course!! It is safe to give your SS # to a Federal Government Agency when you are making a complaint about a CRA where your SS# is the identification

Also does my reply to Experian need to be in weird font or can it be normal? ONLY the INITIAL dispute letter is done "weird" everything else is properly typed and "Courtroom Ready"

It appears that Experian is getting irritated about not being able to automatically scan and read and transmit disputes to offshore agents. They can not be allowed to get away with refusing to address a handwritten dispute or a dispute typed in a manner that is not scannable by their automated systems. File an FTC complaint against them for their trickery.

I am in receipt of your letter dated May 24th, 2012 and have included a copy in this correspondence.

 

I properly disputed this account via U.S. Mail Certified # 7011-2970-0000-3145-2105 on May 15th, 2012. You received my dispute on May 18th, 2012. You are in violation of the FCRA and FACTA for refusing to properly investigate my dispute.

 

I have included a copy of my Driver’s License and Social Security Card, along with a copy of the FTC complaint I have filed against your company.

 

I reserve the right to take further action including filing appropriate complaints with the OCR on HIPAA violations, the California Attorney General under the penalty rules of the HITECH Act as issued 11/30/2009, California’s consumer protection agencies, the BBB and to take civil action to recover damages.

 

Please process my legitimate dispute of May 15th, 2012 immediately. Copies of all correspondence will be forwarded to the FTC and I reserve the right to seek civil damages for your violations of the FCRA and FACTA.

I am really mad now. I received letters from TU and EQ - both said they have verified that the account belongs to me. GRRRR.

 

NOW WHAT DO I DO????

WHOA!!! I thought you said that it was ONLY reporting on Ex.!!

 

Was the TU and Eq response from the initial dispute letter, or was it from the follow up letter after the medical DV??

No, it's always been on all three.

 

This was TU and EQ's response after the initial dispute letter. What's next?

OK, sorry, I guess I lost track!!

 

Next step is the medical DV to the CA, one letter for EACH of the CRAs to the CA in the SAME envelope, CMRR if going to a Street address, Certified ONLY if going to a PO Box.

Update - As of this morning the account is GONE from EQ. This is great, but how did that happen? They just sent me a letter saying it was verified - so confused!

 

Also if you can please let me know what to do about my last question above that would be great. Thank you!

Bump for whychat :wave:

It is obvious that the initial dispute worked with Eq., Check with TU to see if it is off there too.

Because you received a written "verification" from Ex, you should send the medical DV to the CA for EXPERIAN only ( presuming TU also deleted)

 

The complaint to the FTC was premature ( my fault ) it will do no harm and may do some good.

I didn't receive verification from EX - they refused to investigate because they considered it "suspicious", which is why we did the FTC complaint. I guess I'll just wait until they respond to that first.

HOLY CR@P. I am in utter shock. As of today, the account is GONE from all three reports! WHYCHAT - THANK YOU SO SO SO SO SO SO SO SO SO SO SO SO SO SO MUCH!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

 

I never received anything stating that they will delete. Should I order a new copy of my reports to use as proof? Did West Asset remove or did the CRAs remove???

 

There is no chance of reinsertion, right? Wow I'm still in shock!

The CRAs removed. Sometimes you just need to outwait the automated responses when you are using the initial dispute letter.

 

You can order new copies, but wait until you get the written response, they may send you new copies with the "official response".

No, I never got a letter of deletion from any CRA. I don't have a hard copy. All I have is an archived report from USAA.

 

When I backdoored experian it says "under investigation".

UGH!!!

 

USAA is a 3rd party reporting system and as such is not useful for documentation.

What seems to have ocurred in your case is that it "fell off" your USAA report while it was being investigated.

 

Wait until you receive a REAL response to the Ex dispute FROM EX!!
